MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: July 20, 1993 SUBJECT: Cost Sharing Arrangement Between the County and Kaufman and Broad, the Developer of the Boeger Ranch Subdivision (7597) for the Construction of the Driftwood Drive Extension to Evora Road in the West Pittsburg Area. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: 1. APPROVE County participation in the cost of extending Driftwood Drive for the maximum amount of$1,367,600 or 59.3% of the actual cost of construction, whichever is the lesser amount, from the following sources: a. West Pittsburg Area of Benefit; full credit for the 300 subdivision lots of.Subdivision 7597: $867,600 b. West Pittsburg Area of Benefit; contribution: $187,400 C. East Central County Travel Corridor Area of Benefit; remaining funds: $246,000 d. West Pittsburg Area of Benefit; reimbursement from the following revenue sources: 1) Any Area of Benefit fees paid on those properties that front on the Driftwood Drive extension that develop in the future, such as the Shriner property or the Boeger property. 2) Any Area of Benefit fees collected from the Calvary Temple project located on Evora Road, opposite the intersection with Driftwood Drive. $66,600 $1,367,600 2. DIRECT the Public Works Director to prepare a credit-reimbursement agreement between the County and Kaufman and Broad to formalize the above cost sharing arrangement and bring the . agreement back to the Board for approval. Reimbursement will not be ma until the agreement is executed and the improvements accepted as complete. Credit, ho r, may be granted provided the improvements are bonded. Financial Impact: None to the General Fund. III. Reasons for Recommendations and Background: On September 24, 1991, the Boeger Ranch Subdivision, Subdivision 7597, was approved by the Board of Supervisors for 300 residential units. The project was conditioned to construct the Driftwood Drive extension between Pacifica Avenue in the Shore Acres area, and Evora Road. The Board approved the project with the stipulation that a cost sharing arrangement between the developer and the County, for the extension of Driftwood Drive, be worked out prior to filing the final map. During the negotiations for the cost sharing arrangement between the County and the Developer, County staff developed several different scenarios for County participation, ranging from $655,000 to $1,928,000. A couple of the cost sharing scenarios were based upon a traffic study that was performed by the developer for the project and identified the percentage of traffic that was attributed to the development (40.7%) and the percentage of traffic attributed to the community of West Pittsburg (59.3%). Other alternatives compared the theoretical road that would be necessary to serve only the development versus the proposed road which will serve the development and the neighboring community. The total project cost is estimated at $2,805,000, which does not include grading costs. The cost sharing arrangement represents about one half the cost of the road improvements. The County share is set at a maximum of 59.3 percent of the actual cost of the road improvements, excluding grading costs. The traffic study for the development indicated that 59.3% of the traffic on the Driftwood Drive extension would be community traffic and 40.7% would be from the subdivision. If 59.3 percent of the actual construction costs are less than $1,367,600, then the County share would be reduced accordingly with the reduction coming from the reimbursement from future development. On December 10, 1991, the Board of Supervisors revised the West Pittsburg Area of Benefit and increased the single family dwelling unit fee to $2,892 per unit. The project area of benefit list was also revised which included a cost participation for the Driftwood Drive extension in the amount of $1,055,000. The West Pittsburg Area of Benefit will be contributing $867,600 in the form of credits and $187,400 in the form of a direct contribution for a total of $1,055,000. This total amount is approved in the West Pittsburg Area of Benefit project list which was reviewed by the West Pittsburg Traffic Advisory Committee during the Area of Benefit revision process. On December 8, 1992, the Board of Supervisors approved using the remaining funds from the East Central County Travel Corridor Area of Benefit for the Driftwood Drive extension. These funds amount to approximately $246,000. The amount is approximate and could vary. Any increase or decrease in the fund balance would result in a corresponding increase or decrease in the reimbursement from future developments so the total would remain $1,367,600. The West Pittsburg Traffic Advisory Committee and the West Pittsburg Municipal Advisory Council have both reviewed and approved this cost sharing arrangement. IV. Consequences of Negative Action: No cost sharing arrangement would be established for the preparation of the formal credit- reimbursement agreement for the Driftwood Drive extension.
