SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Acknowledge receipt of a petition filed by the Deputy Sheriffs' Association (DSA)
for formal recognition as a majority representative of certain sworn management
classifications in the Sheriff's Department.
FISCAL IMPACT:
None.
REASONS FOR RECOMMENDATION/BACKGROUND:
In accordance with Section 34-12.004 of the County's Employer-Employee Relations
Resolution 81/1165, on June 22, 1993, DSA filed a petition for formal recognition
as a majority representative of the following sworn management job classifications:
Assistant Sheriff
Captain
Lieutenant
Proof of employee approval exceeds the minimum thirty percent (30%) requirement
for qualifying the petition.
By copy of this Board Order, other recognized employee organizations are advised
that intervention in the unit determination process and/or to appear on a
representational election ballot requires 30% of employee approval and must be
submitted within twenty-one (21) calendar days following acknowledgement of
receipt of the petition.

In accordance with Section 34-12 . 004 of the County Employer-
Employee Relations Resolution ( 81/1165) , this is to advise the
Board of Supervisors that the Contra Costa County Deputy Sheriffs '
Association (DSA) has filed a request to form a bargaining unit
consisting of the following sworn management classifications :
Assistant Sheriff
Captain
Lieutenant
In support of this request, the DSA references a petition submitted
April 13, 1993 containing signatures of sworn management employees
in classifications proposed for inclusion in the representation
unit. As provided in Section 34-12 . 002 of Resolution 81/1165, the
petition signatures have been counted and at least thirty percent
( 30%) of the employees in the proposed bargaining unit have given
their endorsement. I recommend that the Board acknowledge receipt
of the request and the petition for formal representation.
By copy of this memorandum, other recognized employee organizations
will be notified that the petition has been filed and advised that
intervention in the unit determination process and/or to appear on
a representational election ballot requires thirty percent (30%) of
employee approval . This notice will also be posted in the Sheriff ' s
Department and the County Administration Building.
All interested parties are advised that the twenty-one (21) day
filing period to petition as above commences on the day following
Board acknowledgement of receipt of this petition on Wednesday,
July 14 , 1993 .

RE: This Petition to Represent Certain Sworn
Management Classifications in the Sheriff's Department
Dear Mr. Heyne:
Please consider this a request for formal recognition as a
majority representative pursuant to Section 34-12 . 002 of Board
Resolution No. 81/1165. This Petition is filed on behalf of my
client, the Contra Costa County Deputy Sheriffs' Association (DSA) .
The DSA is already a recognized employee organization with the
County, under Section 34-10. 002 . You already have the information
concerning the DSA, said information having previously been filed
under Section 34-10. 004 . The organization continues to have no
restriction on membership based on race, color, creed, national
origin, sex, age or physical impairment.
The classifications we wish to represent are those sworn
command level employees of the Sheriff, consisting of Lieutenant,
Captain, and Assistant Sheriff. The bargaining unit would consist
of all three such classifications.
Our proof of employee approval is payroll dues deduction
evidence, which would reveal that over two-thirds of the employees
in question are members of the DSA. Enclosed herewith is a copy of
a certification by the County Auditor-Controller showing such proof
of employee approval.
In a very real sense, you can consider- this Petition a
follow-up to the informal recognition request having been served by
a group of Contra Costa County Sheriff-sworn (peace officer)
management employees upon you on or about April 9, 1993 . You will
have noted from that petition that the management employees in
question denominated the DSA as the representative of its choice.

Please respond to the undersigned if you agree that the
proposed bargaining unit is appropriate. If you would like to omit
a class from the proposed bargaining unit, and you would otherwise
find that unit to be appropriate, with that omission, please let me
know immediately. We might be willing to amend our Petition to
respond to such a concern.
Because of the overwhelming number of people in the unit who
are members of the DSA, I think you will agree with me that no
election is necessary.
I look forward to hearing from you at your earliest possible
convenience.

We have asked labor lawyer Ron Yank to come lead our discussion.
He will talk about the pros and cons of organizing. Discuss
options about with whom to affiliate. Suggest alternatives to
formal organizing.
We believe that the time has come to explore this option that was
once "unthinkable- to many of us. If you too are concerned or
lust interested in the topic, please come and share your
thoughts. The more people we gather, the better the chance to
develop a suitable plan that will help the majority of us. If you
can't attend, discuss your concerns with someone who will be
there or call Larry Simmons or John Hart to express your ideas.
