MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: August 4, 1992 SUBJECT: Reimbursement to Standard Pacific of Northern California Development Company for Work Performed on Camino Tassajara in the Danville Area. Project No.: 0662-6114162 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: Authorize the Public Works Director to arrange with the Auditor's Office to pay Standard Pacific of Northern California Development Company, reimbursement payment in the amount of $99,282.76. This is for work performed on Camino Tassajara in realigning the Bettencourt curve, as identified on the project list of the Joint Exercise of Powers Agreement between the Town of Danville, the City of San Ramon and Contra Costa County. II. Financial lmpact: None to the General Fund. The reimbursement will be made with fees collected from development in the Tassajara area, specifically for this project. Sufficient developer fees have been collected pursuant to the Joint Exercise of Powers Agreement between the Town of Danville, the City of San Ramon and Contra Costa County. III. Reasons for Recommendations and Background: In 1987 the Town of Danville, the City of San Ramon and Contra Costa County entered into a Joint Exercise of Powers Agreement(JEPA) entitled"Tassajara Area Transportation Improvement Fees." The JEPA established fees that would be charged for certain properties developing within the Tassajara,area.. The fees would fund improvements in the Town, the City and the County to mitigate the traffic impacts from these developing properties. Reasons for Recommendations and Background cont: One of the projects listed in the project report of the JEPA was the realignment of the curve on Camino Tassajara along the frontage of the Bettencourt Ranch. Initially, the County was to design and construct the realignment of Camino Tassajara. However, the developers felt they could perform the improvement on a time line that would better suit the development of their projects and proposed to perform the realignment of the road as part of their subdivision development. The County concurred,and as a result, Dame Construction Company constructed the realignment of the road, in addition to some major drainage facilities for the Flood Control District, as part of their larger project. This large project represented segments that were funded by Dame Construction Company, Standard Pacific Development Company, the Blackhawk Equestrian Center, the County and the Flood Control District. As part of the realignment of Camino Tassajara, the old sewer main had to be, relocated. This work was funded by Standard Pacific Development Company. The reimbursement payment will reimburse Standard Pacific Development Company for the sewer work necessary as part of the JEPA funded project to realign the Bettencourt curve. IV. Consequences of Negative Action: Standard Pacific Development Company would not be paid for the work they have done for Contra Costa County.
