SUBJECT: ESTABLISHMENT OF A COMBINED SUBSTANCE ABUSE ADVISORY BOARD
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Abolish the existing Alcoholism Advisory. Board, effective
August 12, 1992 .
2 . Abolish the existing Drug Abuse Board, effective August 12,
1992 .
3 . Adopt the attached Resolution creating a Substance Abuse
Advisory Board, to succeed both of the other two advisory
boards which have just been abolished, pursuant to the
provisions of AB 3383 (Chapter 296, Statutes of 1990) .
4 . Appoint to the newly created Substance Abuse Advisory Board
all of the individuals who are members of either the
Alcoholism Advisory Board or Drug Abuse Board as of August 11,
1992, for the remaining term to which each individual had been
appointed to either the Alcoholism Advisory Board or Drug
Abuse Board.
5 . Declare as a matter of Board policy that the Board of
Supervisors intends that the Substance Abuse Advisory Board
fully comply- with all provisions of AB 3383 (Chapter 296 ,
Statutes of 1990) by no later than June 30, 1995 .
6 . Indicate that in order to bring the Substance Abuse Advisory
Board fully into compliance with Chapter 296, Statutes of
1990, each seat on the Substance Abuse Advisory Board that is
vacated by resignation, declared vacant for lack of
attendance, or where a term of office expires on June 30,
1993, June 30, 1994 or June 30, 1995, ' s to be abolishe until

the Substance Abuse Advisory Board consists of no more than 20
members, at which time the Substance Abuse Advisory Board and
Health Services Director are directed to report to the Board
of Supervisors with their recommendations for any changes in
the composition or terms of office of the Advisory Board,
consistent with Chapter 296, Statutes of 1990 and any related
legislation.
7 . Direct the Health Services Director to review the composition
of the newly constituted Substance Abuse Advisory Board to
determine whether each member of the Advisory Board complies
with the requirements of Health & Safety Code Section 11964 .5
(c) and to report to the Board of Supervisors any deviations
from such compliance so that the Board of Supervisors can
determine whether to allow the individual to continue to serve
pursuant to Health & Safety Code Section 11964 .5 (e) .
8 . Direct the Health Services Director to advise the Clerk of the
Board of Supervisors in writing of the membership of the
Substance Abuse Advisory Board as of August 12, 1992,
including the term of office for each member, consistent with
the above recommendations .
9 . Direct the Health Services Director and the members of the
Substance Abuse Advisory Board to insure that the meetings and
activities of the Substance Abuse Advisory Board are, governed
by Health & Safety Code Section 11964 .5 .
10 . Direct the Health Services Director to forward to the State
Department of Alcohol and Drug Programs a certified copy of
this Order and the attached Resolution, advising the
Department that the Board of Supervisors has elected to
exercise its option pursuant to Health & Safety Code Section
11964 . 5 (a) .
BACKGROUND:
In 1989, the Board of Supervisors sponsored legislation introduced
by Assemblyman William Baker (AB 3383) which authorized a County to
combine its Alcoholism Advisory Board and Drug Abuse Board into a
combined Substance Abuse Advisory Board. This legislation was
enacted as Chapter 296, Statutes of 1990 .
The Health Services Director has been working toward the
consolidation of various elements of the substance abuse programs
for some time. He is now prepared to recommend the consolidation
of the advisory boards .
Chapter 296 , Statutes of 1990 enacted Health & Safety Code Section
11964..5 . This section does the following:
1 . Authorizes a County, by the adoption of a Resolution .by the
Board of Supervisors, to elect to satisfy the provisions of
this section, rather than the existing law pertaining to the
required separate alcohol advisory board and drug advisory
board.
2 . Allows a Board of Supervisors, in order to transition to a
combined advisory board, to initially combine the existing
separate advisory boards .
3 . Specifies, based on existing law applying to the separate
advisory boards, who can and can not be members of the
combined advisory board.
4 . Provides that if a . member ceases to retain the status which
qualified him or her for membership on the combined advisory
board that his or her membership shall cease and there shall
be a vacancy on the combined advisory board.

5 . Requires the Board of Supervisors to specify in the Resolution
combining the advisory boards, the term of office for members
of the combined advisory board and provides that members
already serving a term on an existing advisory board may be
allowed to serve out that term, providing that the individual
met the qualification for membership on either of the
preexisting advisory boards at the time the advisory boards
were combined.
6 . Requires the combined advisory board to meet at least every
other month and provides for payment of actual and necessary
expenses for member of the combined advisory board.
7 . Requires that all meetings of the combined advisory board be
open pursuant to the Brown Act.
8 . Specifies the duties of the combined advisory board.
9 . Requires that even if the advisory boards are combined that
the integrity of the separate drug and alcohol programs be
maintained.
Approval of the above recommendations will comply with Health &
Safety Code Section 11964 . 5 and will effect the combining of the
Alcoholism Advisory Board and Drug Abuse Board.

Health & Safety Code Section 11964 .5 having been enacted by AB 3383
(Chapter 296, Statutes of 1990) , providing that a county may
combine its alcohol advisory board and drug abuse board, and
The Health Services Director having recommended that the Board of
Supervisors proceed to implement Section 11964 .5 in Contra Costa
County;
NOW, THEREFORE, BE IT BY THE BOARD OF SUPERVISORS RESOLVED:
That the Board of Supervisors elects to be governed by the
provisions of Health & Safety Code Section 11964 .5, rather than
Health & Safety Code Sections 11805 and 11964, and
BE IT FURTHER RESOLVED, that the terms of office for members of the
Substance Abuse Advisory Board shall be three years, to expire June
30, and that each member initially appointed to the Substance Abuse
Advisory Board shall serve a term ending on the date his or her
term would have expired had the individual continued to serve out
the term to which he or she had been appointed on the Alcoholism
Advisory Board or Drug Abuse Board.
