ERArDON County DIRECTOR OF C-))MIUNITY DEVELOPMENT DATE: August 3, 1992 SUBJECT: VILLANOVA DRIVE COUNTY BOUNDARY CHANGE MINOR MODIFICATION SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Adopt the ordinance revisions approving the Villanova Drive /County Boundary change. 2. Direct staff to finalize the paperwork on this County boundary change. FISCAL IMPACT None - the change only affects publicly-owned land. BACKGROUND/REASONS FOR RECOMMENDATIONS DISCUSSION: Previously, your Board adopted a citizen-initiated request for the boundary change between Alameda and Contra Costa Counties pursuant to Article 4 of Division 1 of the California Government Code (23200 et seq. ) . This adoption transferred approximately 2 acres from Contra Costa to Alameda County/City of Oakland and less than one acre from Alameda to Contra Costa County. The City of Oakland requests an amendment to delete the less-than- one-acre action (detachment from Alameda and annexation to Contra Costa County) in order to correct their clerical error which erroneously included this action. This amendment reflects the action taken by the Oakland City Council and is agreeable with the Alameda County and City of Oakland staffs. The Alameda County Board of Supervisors approved this minor change on June 30, 1990. The effective date for this boundary change is September 1, 1992. ORDINANCE NO. 92- 57 (Amending Ordinance No. 92-12 Re Minor County Boundary Line Change for Villanova Drive Area) i. The Contra Costa County Board of Supervisors ordains as follows: SECTION 1: On February 25, 1992, pursuant to duly noticed hearing, the Board of Supervisors of the County of Contra Costa adopted Ordinance 92-12, approving the Villanova Drive Minor County Boundary Change between Contra Costa County and Alameda County. Said Boundary Change was 1) to delete approximately one acre from Alameda County and add that same territory to Contra Costa County and 2) to delete approximately two acres from Contra Costa County and add that same territory to Alameda County. SECTION 2: Alameda County has not completed the Boundary Change as originally approved by this County, and instead has approved a modified proposal which only deletes the approximately two acres from Contra Costa County and adds that same territory to Alameda County. The modified proposal, as approved by Alameda County, would not delete the approximately one acre from Alameda County and add the same territory to Contra Costa County. SECTION 3 This Board concurs with the modified proposal, as approved by Alameda County, and hereby amends Ordinance 92-12 to accord with the modified proposal. Said Ordinance 92-12 and all supporting documents are hereby amended to reflect that the only change to the boundary shall be the deletion of approximately two acres from Contra Costa County and the addition of that same territory to Alameda County. SECTION 4: The effective date of this Boundary Change shall be changed to September 1, 1992. SECTION 5: The Clerk of this Board shall transmit a certified copy of this Ordinance to the Board of Supervisors of Alameda County.
