MICHAEL WALFORD, CHIEF ENGINEER DATE: AUGUST 11, 1992 SUBJECT: APPROVE CONSULTING SERVICES AGREEMENT WITH WOODWARD-CLYDE CONSULTANTS, INC. FOR TECHNICAL ASSISTANCE IN THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT PROGRAM Project No.: 7505-6178243 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chief Engineer to execute the consulting services agreement with Woodward-Clyde Consultants, Inc. to perform services culminating in an application for a NPDES Permit for stormwater discharges (Part II) to the San Francisco and Central Valley Regional Water Quality Control Boards for Contra Costa County, its incorporated cities and the Contra Costa County Flood Control and Water Conservation District. II. Financial Impact: The contract cost is $365,795.15. The cost shall be funded by the cities and County proportionate to their respective populations. III. Reasons for Recommendations and Background: The United States Environmental Protection Agency issued National Pollutant Discharge Elimination System (NPDES) Regulations for stormwater discharges on November 16, 1990. These regulations required Contra Costa County, its incorporated cities and the Contra Costa County Flood Control and Water Conservation District to apply for a NPDES Permit for their stormwater discharges. Div: Public Works (FC) of Supervisors and C my Administrator cc: -L' Deputy Ae%w /-37 Woodward-Clyde Consultants August 11, 1992 Page Two An organization was formed called the Contra Costa Cites ♦ County ♦ District Stormwater Pollution Control Program comprising of all twenty (20) municipalities. Its primary objective has been to obtain an area-wide Municipal NPDES Permit. The first part of the three step process required municipalities by May 18, 1992 to submit Part I of the NPDES Permit. This task was accomplished and Part II of the Application is due on May 17, 1993. Once the Part II Application has been reviewed, it is anticipated that the area-wide Municipal NPDES Permit shall be granted by the Regional Boards in the fall of 1993. The Board of Supervisors on April 23, 1992 authorized a sole source consulting services agreement with Woodward-Clyde Consultants and on June 23, 1992 approved the County's participation in the Part II effort at a cost not to exceed $200,000. The Contra Costa Cities County ♦ District Stormwater Pollution Control Program's Technical Coordination Committee recommends execution of this contract. Presentations have been made to the Contra Costa Public Managers' Association and the Contra Costa Mayors' Conference. The contract with Woodward-Clyde Consultants shall provide the technical assistance to comply with all requirements necessary to complete the Part II Application. IV. Conseguences of Negative Action: If the contract with Woodward-Clyde Consultants is not approved the Application will not be completed by the required deadline which may result in fines totalling $25,000 per day for all affected entities.
