SUBJECT: COLLECT and CONVEY DRAINAGE REQUIREMENTS for
MINOR SUBDIVISION NO. 47-89 (PAGNI - CROCKETT AREA)

I. Recommended Action:
1. ACCEPT this report regarding a request from Mr. Medro Pagni for relief from the
`. "collect and convey" requirement on Minor Subdivision No. 47-89.
2. APPROVE the following as an alternative condition of approval to the "collect and
convey" requirement of Ordinance Code Section No. 914-2.00:
a. All drainage to and from the site shall be conveyed across said site in an
adequate, maintainable, drainage facility, in accordance with Ordinance Code Section
No. 914-2.00, to the existing roadside ditch.
b. Developer shall insure that the existing roadside ditch along Bishop Road has
sufficient capacity to contain the storm flows to its point of discharge into the drainage
facility located to the east of the development.
c. Developer shall reconstruct the drainage swale at the intersection of Emerson
Avenue and the small private road that provides access to the upper lot of the minor
subdivision. The reconstruction of the intersection shall insure that the surface flows
on Emerson Avenue are contained in the gutter on Emerson Avenue and not directed
down the private road.

d. Developer shall be required to pay a drainage deficiency fee in order to mitigate
the accumulative hydrology impact from this development. The drainage deficiency
fee amount, based upon $1.00 per square foot of impervious surface generated by
this development, is calculated to be $4850.
3. ADOPT the following findings pursuant to Chapter 92-6,"Exceptions",of the Ordinance
Code in order to approve the alternative conditions of approval:
a. There are unusual circumstances or conditions affecting this property. Bishop
Road in the vicinity of the minor subdivision is fairly flat in grade. The adequate man-
made drainage facility east of the subdivision on Bishop Road is too shallow for this
development to drain in to and still be in compliance with our collect and convey
ordinance.
b. The exception is necessary for the preservation and enjoyment of a substantial
property right of the applicant.
c. The granting of the exception will not be materially detrimental to the public welfare
or injuries to other property in the territory in which the .property is situated. The
amount of storm water runoff from the new impervious surfaces, approximately 4850
square feet, is minor In comparison to the size of the water shed.
I1. Financial Impact:
There is no financial impact to the County.
ill. Reasons for Recommendations and Background:
The project is located in the Bishop Road area of Crockett and contains an existing occupied
house. Mr. Pagni wants to subdivide this site into two parcels, one of the parcels will be
vacant and the other will be occupied by the house.
Unfortunately, the existing local drainage facilities in this area were installed at a very shallow
depth which prevents this development from draining into them.
Staff has reviewed this development and visited the site to determine the best drainage
solution that meets the requirements of"collect and convey". They have concluded that there
is no way to lower the existing drainage system because most of the system is located on
already developed private property with limited access and no easements. Trying to
reconstruct the existing drainage system would be very detrimental to the existing
developments in the area.
In addition, the area Is hilly and it appears that all the storm waters are contained within the
curbs and gutters along the streets. Staff saw no evidence of any property damage that
would occur from surface flows in the area.
Staff recommends that since the Developer is unable to meet our "collect and convey"
requirements due to existing field conditions, that the Board permit the alternative condition
of approval in lieu of full "collect and convey". The proposed contributions and drainage
improvements will enhance regional drainage. The cash contribution will be pooled with
other monies to implement additional drainage improvements to service this area.
IV. Consequences of Negative Action:
Full requirements of "collect and convey" would not allow this development to take place.
