SPECIFIC REQUEST (S) OR RECOMMENDATIONS (S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Authorize the Executive Director or his Designee to enter into a Legal
Services Contract with the firm of Jaffe, Trutanich, Scatena & Blum;,
and authorize the filing of a complaint for damages against various
defendants.
FISCAL IMPACT
No General Funds are involved. The litigation costs will be shared
equally by the Redevelopment Agency and the seller of the Hookston
Station property on an equal basis. Agency funds to be used are funds
paid by the Agency to the seller for. the property and held in escrow
explicitly for remediation of toxic substances.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On June 20, 1989 the Board of Supervisors and the Redevelopment
Agency approved the acquisition of the Hookston Station property
from John B. Hook et. al. (seller) . The property is located within .
the Pleasant Hill BART Station Area. The property purchased will
ultimately be part of an arterial that will connect at Pleasant
Hill BART Station Area with Monument Boulevard. The property
constitutes a portion of the former Southern Pacific right-of-way
between Mayhew and Hookston roads.
The Purchase Agreement provided for a toxic investigation to be
completed and that a portion of the purchase price held in escrow
in an interest bearing account to reimburse the County for
reasonable costs incurred in remediating any toxic conditions on
the property. Preliminary site assessments and subsequent
investigations have determined that contaminants exist on this
site.
Under Federal and State law, the Agency and the seller may seek
relief from prior owners and tenants of the property whom the
Agency and seller believe may have caused the toxic materials to be
placed on the property.
