AUTHORIZE LETTER TO THE ALCOHOL BEVERAGE CONTROL TO OBJECT TO THE
SUB.IECTI APPROVAL OF ADDITIONAL LIQUOR STORES IN NORTH RICHMOND AND WEST
PITTSBURG AND CONSIDER REQUIRING LAND USE PERMIT FOR NEW LIQUOR

RECOXNENDED ACTION:
(1 ) Authorise the Chair of the Board to send a letter to
the Department of Alcohol Beverage Control objecting to the approval
of liquor stores in the North Richmond and West Pittsburg.
. (2) Refer the permit and zoning considerations to the
Community Development Department and to both municipal advisory
councils for a report on the feasibility of further planning steps for
the approval of liquor stores.
BACKGROUND INFORMATION:
Comm city groups and civic leaders have approached us with
serious concerns on these subjects. As part of the Board of
Supervisor's overall commitment to address problems in North Richmond
and West Pittsburg, we recommend that the Board send a letter to the
Department Alcohol Beverage Control objecting to the approval of new
liquor stores in West Pittsburg and North Richmond. (Please reference
the attached letter from Supervisor Torlakson and Debra Mason,
President of the West Pittsburg Pride Committee to the Department of
Alcohol Beverage Control. )
In addition, an investigation should be conducted on the
possibility of a special permit or' zoning overlay requiring a land use
permit for new liquor stores in areas where there are already high
concentrations of such businesses and community concern regarding law
enforcement problems .

The Board discussed the above recommendations in some detail and agreed to amend
recommendation #1 as follows: (1) Authorize the Chair of the Board to send a letter to the
Department of Alcohol Beverage Control and the Sheriff objecting to the approval of
additional liquor stores in the North Richmond and West Pittsburg areas.

Re: Alcoholic Beverage Licenses
West Pittsburg Area
Thank you for your recent letter concerning the issue of
alcoholic beverage license applications for locations within the
West Pittsburg area.
Please be assured that I too am concerned about the poten-
tial impact the issuance of additional alcoholic beverage licens-
es may have on the West Pittsburg area. As I'm sure you are
aware , the Alcoholic Beverage Control Act requires that a thor-
ough and complete investigation be conducted by the Department
prior to the issuance of any alcoholic beverage license. Atten-
dant to the investigation, there are several statutory and
regulatory requirements which mandate that public notice be
provided to nearby residents as well as the public entities most
directly affected; ( i.e . , boards of supervisors, city councils,
law enforcement and zoning authorities) . These measures are
taken in order to provide citizens and local agencies the oppor-
tunity to file protests which are then investigated. In many
cases testimony is introduced at public hearing prior to a final
decision on a particular license application.
I have taken the liberty of sending a copy of your letter to
District Administrator Edward Conner of the Department's Oakland
District Office. I've asked Mr. Conner to review the current
situation concerning alcoholic beverage licenses issued in the
West Pittsburg area. After that initial assessment is completed,
Mr. Conner will then contact your offices to arrange for a
meeting with you both or designated members of your staffs to
discuss the matter. I anticipate that Mr. Conner will contact
you sometime during the last week of July. Mr. Conner may be

in care of the Department at 7677 Oakport street, suite 1020,
Oakland, CA 94621 .

We would like to formally register our strong objection
to the approval of any liquor store applications in the West
Pittsburg area adding to the already high concentration of
liquor stores . We would like to request notification of any
liquor store applications for the West Pittsburg area.
West Pittsburg residents and community leaders have
been working diligently for positive change and in improving
the community's image. Establishing another liquor store in
this area is not conducive to these efforts to improve the
community.
We feel strongly that such establishments have served
as a source of many of the social and crime problems we are
attempting to eliminate. Some liquor stores in our area
have become known trouble spots. Loitering and littering
are some of the problems. Public drinking, selling to
minors and drug dealing are other serious problems we are
experiencing.
We would appreciate your assistance.
