Open public hearing and receive testimony on proposed plan amendment request. 2. Certify as adequate the Negative Declaration on this project for the purposes of acting on the General Plan Amendment. 3. Close public hearing and APPROVE the General Plan Amendment as recommended by staff and to direct staff to include it in one of the consolidated General Plan Amendments for 1992. ZISCAL IMPACT Plan Amendment costs are covered by developer fees. BACKGROUND/REASONS FOR RECOMMENDATIONS The Garrett/Wildes General Plan Amendment was recommended for approval by the East County Regional Planning Commission on April 13, 1992 by a unanimous vote. At that meeting, the Regional Planning Commission certified the Negative Declaration and approved General Plan text changes to be incorporated into this project. The Regional Planning Commission's resolution discussed placing a housing unit cap of 17 units and four units on the Garrett and Wildes properties respectively and that the sloped areas of both properties be dedicated as open space. These text changes are outlined in more detail in Attachment A. (applicant) and George and Margaret Wildes (owners) for a General Plan Amendment from Open Space to Single Family Residential, High Density and Single Family Residential, Low Density. The General Plan amendment would accommodate up to 17 residential units on the Garrett piece of property and up to four units on the Wildes piece of property (GPA 10-91-EC) in the West PittsbuiZ area. Jim Cutler presented the staff report on the request, describing the site location, and advised of the staff recommendation on the request as stated above. Supervisor Torlakson requested clarification on the continuance of the trail system. Mr. Cutler responded to Supervisor Torlakson's request commenting on the options available for the trail. r qk♦ _ The public hearing was opened and the following person appeared to speak: Steven Cross, Bellecci and Associates, Inc. , 2290 Diamond Boulevard, #100, Concord, representing Garrett Development Company, . spoke in favor of the proposed amendment. The public hearing was closed. Orig: Community Development Department ATTESTED July 21 , 1992 cc: Public WorksPHIL BATCHELOR, CLERIC OF CAO THE BOARD OF SUPERVISORS County Counsel CO ADKINIBTRATOR 0BY O , DEPUTY 0►AXORT-WL08.50 ATTACHMENT A Contra Costa County Board of Supervisors Garrett/Wildes General Plan Amendment Proposed Changes to the 1991 County General Plan To integrate the Garrett/Wildes General Plan Amendment into the Countywide Generg Plan, the land use element plan map will be changed to reflect Single Family Residential and Open Space for the Garrett piece and Single Family Residential, Low Density for the Wildes piece. The boundaries of the proposed change are shown in Map A of the staff report. A new policy will be added on page 3-61 of the County General Plan which would read: "3-100 Development of the Garrett property, which represents the eastern portion of the Garrett/Wildes plan amendment area shall be limited to 17 units. The edges of the Garrett project shall be retained in the Open Space land use designation, as shown on Map A, and provide landscape buffers to reduce visual impacts of development. The Wildes property, which fronts along Mota Drive, and is the western piece of the plan amendment area contains sloped areas along the southern portion of the property which should remain undeveloped. The sloped area is generally shown by the Open Space designation on the Wildes property. Development of the Wildes property shall be limited to four parcels. The new lots should avoid development on the sloped areas and to the extent possible, provide access from Rio Lane so as to avoid potential circulation conflicts with traffic at the Mota Drive/Azores Circle intersection." The amendment area shall also be located on Figure 3-2 of the Countywide General Plan as shown on map A. GPA 3\G ARRETT\NE W TEXT.G P H. 3 BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on July 21, 1992 by the following vote: AYES: Supervisors Fanden, Schroder , Torlakson and McPeak NOES: None ABSENT: Supervisor Powers ABSTAIN: None RESOLUTION NO. 92/492 SUBJECT: In the Matter of the Garrett/Wildes General Plan Amendment (#10-91-EC) The Board of Supervisors of Contra Costa County RESOLVES that: There is filed with this Board and its Clerk a copy of Resolution No. 32-1992, adopted by the East County Regional Planning Commission, which discusses a general plan amendment for the West Pittsburg area (#10-91-EC). On July 21, 1992 the Board held hearings on the said general plan amendment discussed by the East County Regional Planning Commission Resolution 32-1992. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings called for testimony of all persons interested in this matter. After taking testimony, the Board closed the public hearing and approved the general plan amendment as recommended by staff. The Board also directed staff to include the Garrett/Wildes plan amendment in one of the consolidated general plan amendments as allowed by State Planning Law. The Board finds that the proposed plan amendment will not have a significant impact on the environment because the mitigation measures which will be applied to the forthcoming subdivision will resolve all potential significant impacts. An Environmental Initial Study and Mitigated Negative Declaration was prepared and adopted by the Board for the Garrett/Wildes General Plan Amendment. These actions satisfy the requirements of the California Environmental Quality Act (CEQA) and County CEQA guidelines. The Board members having fully considered the general plan amendment discussed in Resolution No. 32- 1992 and the recommendations included in the County Community Development staff report dated July, 21 1992, which was included in the Board's July 21, 1992 packet hereby adopts the Garrett/Wildes General Plan Amendment as recommended by staff.
