HomeMy WebLinkAboutMINUTES - 09241991 - 1.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 24, 1991 by the following vote: AYES: Supervisors Fanden, Schroder, Torlakson and McPeak NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Authorizing the Public Works Director to Arrange for Completion of Improvements, and Authorizing County Counsel to Secure Funds for Completion of Improvements, Subdivision 6696, Tassajara Area. The Board on June 13, 1989, having approved a Subdivision Agreement with Bruce and Joan Flanagan for construction of certain improvements in Subdivision 6696, Tassajara area. The Public Works Director having reported that the developer has filed for bankruptcy and has failed to satisfactorily complete the work as required by said agreement. The Public Works Director having recommended that he be authorized to arrange for completing the work (estimated to be $123, 600, plus the cost of preparing plans and specifications, solicitation of bids, and administering the contract) using the $1,236 cash deposit (Auditor's Deposit Permit No. 157197, dated May 26, 1989) made by Bruce and Joan Flanagan to help defray the County's cost. The Public Works Director having further reported that the County cannot fund the construction of said improvements without first obtaining monies from the surety securing the agreement, and recommends that County Counsel be authorized to proceed lagainst the corporate surety bond dated May 18, 1989, and issued by Insurance Company of the West (Bond No. 113 4205) in the amount $122,562 for faithful performance. IT IS BY THE BOARD ORDERED that the recommendations of the Public Works Director are APPROVED. IT IS .FURTHER ORDERED that County Counsel is AUTHORIZED to request payment from, and if necessary, to prosecute legal proceedings against the developer and Insurance Company lof the West to make the funds available to complete said improvements and to defray County' s costs incurred in securing said funds.
