COStd September 9 Count 1991 DATE: sT,l.._= �• J coin REPORT ON THE ENFORCEMENT OF CONDITIONS OF APPROVAL FOR THE SUBJECT: ACME TRANSFER STATION AND HOST MITIGATION FEE FOR THE ACME TRANSFER STATION SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1. Accept the attached status report from the Community Development Department on the status of the enforcement of the conditions of approval for the Acme Transfer Station. 2. Request staff from the Community Development Department to obtain monitoring data from Acme approximately one month after Acme has had in place a security guard responsible for determining who, in fact, is using the gate access from the Arthur Road area and report that data to our Committee along with staff ' s recommendations, on October 28, 1991. 3 . Request staff from the Community Development Department to consider the issue of host community mitigation for the residents of the Arthur Road area as a part of the negotiations on the franchise for the Acme Transfer Station and report the results of those negotiations as they relate to the issue of host community mitigation to our Committee as events warrant such a report. Attached is a status report from Chuck Zahn in the Community Development Department responding to each of the requests made by the Board. On September 9, 1991 our Committee met with Chuck Zahn and Louise Aiello from the Community Development Department, Dorothy Sakazaki a resident of the Arthur Road area, and Jim Pezzaglia, representing Acme Landfill. We believe that the attached report adequately provides a status report on the referrals made by the Board. We have asked for further information on the question of the access gate, since Acme has agreed to post a security guard there to try to determine who is leaving the gate open and who is gaining access to this area as a result of the gate' s being left open. We will review that data next month and will report our conclusions and recommendations to the Board thereafter. As is noted in the attached report, the question of host community mitigation needs to be addressed as a part of the negotiations over the franchise for the Acme Transfer Station and are a part of the discussions regarding the possibility of forming a joint powers authority to purchase the Acme Transfer Station. cc: County. Zahn, Assistant Director--Conservation Programs SUBJECT: STATUS REPORT--ACME TRANSFER STATION CONDITIONS OF APPROVAL The status of the matters covered in the Board's June 10, 1991 Board Order, regarding the Conditions of Approval for the ACME Transfer Station, is outlined below. 1. Removal of Concrete Blocks. The concrete blocks were removed in July, 1991 by Public Works Department staff. 2. Host Mitigation Compensation. Host mitigation compensation will be considered as part of the negotiations on the Franchise for the ACME Transfer Station. These negotiations are closely related to the negotiations to establish a public agency Joint Powers Agreement for the purchase of the ACME Transfer Station. Resolution is not concluded. 3. Litter Control/Sheriff-Coroner. Discussions with Public Works Department and Sheriff Department staff resulted in an understanding by Sheriff Department staff that they will explore general litter control financing in connection with disposal facility franchising. 4. Gate Access--Arthur Road Area. ACME has undertaken efforts to assure minimal use of the gate at Arthur Road and its closure. New locks were placed on the gate; however, these were shot off. Discussions with the Gun Club regarding methods to monitor use of the gate resulted following the incidents with the gate locks. At this time, ACME believes it is important to determine exactly what is happening in the area. To do so, a guard will be posted at the gate to verify users and to provide information regarding problems that may occur. Previously, consideration was given to a second gate at the entrance to the Transfer Station which might have inhibited use of the Arthur Road access. Due to the relocation of the new intersection southward, an additional gate at the Arthur Road access is no longer practicable. ' CAZ:se CZ:UOAcme.mem
