Direct the Growth Management Agency to examine the extent to which the service centers of counter work ( 067) , General Plan Maintenance ( 020) , Code Enforcement (066) and Family Member Mobile Home permits ( 024) should be financed by the General Fund. 4. Direct the Growth Management Agency, in cooperation with the Auditor' s Office, to study the feasibility of a minimum fee for applications, with additional fees included if the time and materials necessary to process the application exceed the minimum standard. 5. Endorse the concept of establishing a Land Development Fund. BACKGROUND: On September 10, the Board of Supervisors referred the proposed fee adjustments for Community Development, Public Works and Building Inspection to the Finance Committee for study. The Committee met on September 16 and took testimony from staff and representatives from the Building Industry Association, A.D. Seeno Construction Company, Growth Management Agency, Auditor' s Office and County Counsel' s Office. The Finance Committee agreed to endorse the proposed fee adjustments but, agreed that further study should be conducted to evaluate the operational efficiency of land development services. The Director of the Growth Management Agency indicated that the study will require at least a year in length, and is already underway. The Committee requested an interim report in six months. Specific service centers were discussed in terms of whether fees should fully offset costs or whether the General Fund is more appropriate. The Committee agreed that the following service centers should be studied relative to General Fund financing: Counter Work ( 067) General Plan Maintenance ( 020) Code Enforcement ( 066) Concerns were expressed about the much longer time and higher cost necessary to process applications which are poorly prepared versus applications which are well prepared. The Committee agreed to request the Growth Management Agency to study the feasibility of a minimum fee with increased amounts for applications which require more time and cost above the minimum fee standard. The Finance Committee discussed some individual fees in detail and determined that the following proposed fees should be adjusted: • Home Occupation permit ( 026) from $1, 370 per permit to $500 • Planning Commission Appeals ( 047) from $560 to $500 for applicants, and from $560 to $110 for non-applicants • Board of Supervisor Appeals ( 048) from $890 to $500 for applicants, and from $890 to $110 for non-applicants • Reconsideration Review ( 049) from $640 to $500 for applicants, and from $640 to $110 for non-applicants Finally, the Committee endorsed the concept of establishing a Land Development Fund to improve the accountability of funds and services. Direct Growth Management and Economic Development Agency Director to coordinate collection of the new fees and reimbursement to each department for the costs they incurred providing the services. 3 . Direct County Administrator to work with Building Inspection, Community Development, and Public Works to explore feasibility of isolating land development revenues and costs into a separate fund. FISCAL IMPACT Adoption of this resolution should result in a decrease of General Fund expenditures on activities in these three departments. BACKGROUND A hearing has been set and notification given to increase and adjust fees in the Growth Management and Economic Development departments. A corresponding Urgency Interim Ordinance is also on the agenda. If made effective immediately, additional revenue could be realized before the end of the first quarter. Timely adoption of fee adjustments is very important for land development applications, construction permits, inspections, and most of the other construction/development related services being considered in the resolution. Revenue generation is greater now during the good construction months, rather than later during the winter, rainy months. The proposed fees are the result of the first phase of a Countywide, fee study being done by an independent consultant, Management Services Institute. , Inc. (MSI) . A major objective of this cost/revenue comparison study ' is to raise fees to a level adequate to cover a service' s actual costs and thereby eliminate General Fund subsidies. During phase one, MSI and County staff focused on approximately 85 County services where the Board of Supervisors has fee setting authority. At the August 12, 1991 budget hearing, anordinance was adopted listing the 85 plus services and recommending 100% fee recovery. A presentation by the consultant regarding the philosophy of their study, specific findings, and other information pertinent to adoption of specific fee amounts was made earlier this month. The second recommendation recognizes that the benefits of the proposed fee increase will only be realized with cooperation from Public Works, Community Development and Building Inspection staff and support from departmental leadership. Recommendation three, the creation of a separate land development fund, was suggested by MSI and will require further exploration before a decision to implement can be made. BACKGROUND, FINDINGS . 1 . The County of Contra Costa has conducted an extensive and exhaustive analysis of its services, the costs reasonably borne of providing those services, the beneficiaries of those services , and the revenues produced by those paying fees and charges for special services . 2 . The County wishes to comply with both the letter and the spirit of Article XIIIB of the California Constitution and limit the growth of taxes . 3 . The County desires to establish a policy of recovering the full costs reasonably borne of providing special services of a voluntary and limited nature, so that general taxes are not diverted from general services of a broad nature and used to unfairly and inequitably subsidize special services . 4 . Heretofore, the Board of Supervisors has adopted Ordinance No . 91-40 on August 12, 1991 , establishing its policy on the recovery of costs, particularly, the percentage of costs reasonably borne from users of County services and directing staff as to the methodology for implementing said ordinance. 5 . It is the intention of the Board of Supervisors to develop, as necessary, a revised schedule of fees and charges based on the County' s budgeted and projected costs reasonably borne, for each Fiscal Year, beginning with the Fiscal Year commencing July 1 , 1991 . 6 . Pursuant to Government Code Section 66016, the specific fees to be charged for services may be adopted by the Board of Supervisors by Resolution, after providing notice of and holding a public hearing at which oral and written presentations may be made, and providing an opportunity to review the supporting data upon which the fees are based at least 10 days before the hearing. This Board finds that all of the requirements of Government Code Section 66016 have been met. B. ADOPTION OF FEES . 1 . Fee Schedule Adoption. The fees set forth in Exhibit A, attached hereto and incorporated herein by this reference are hereby adopted and shall be charged and collected for the services enumerated therein. RESOLUTION NO. 91/630 t 2 . Separate Fee for Each Process . All fees set by this resolution are for each identified process . Additional fees shall be required for each additional process or service that is requested or required. Where fees are indicated on a per unit of measurement basis, the fee is for each identified unit or portion thereof within the indicated ranges of such units . 3 . Added Fees and Refunds . Where additional fees must be charged and collected for completed staff work, or where a refund of excess deposited monies is due, and where such charge or refund is ten dollars ( $10 . 00 ) or less, a charge or refund need not be made, pursuant to and provided the requirements of Government Code Sections 29373 . 1 and 29375 . 1 and amendments thereto are met. 4 . Defining and Timing of Fee Schedule. Definitions regarding and the timing of the implementation of the herein enumerated fee schedule shall be as set forth herein and in Ordinance No . 91-40 . 5 . Interpretation. This Resolution may be interpreted by the several County department heads in consultation with the County Administrator. If there is a conflict between two fees , the lower in dollar amount of the two shall be applied. 6 . Severability. If any portion of this resolution is declared invalid or unenforceable by a court of competent jurisdiction, the Board of Supervisors hereby declares that it would have adopted the remainder of this Resolution regardless of the absence of the invalid part(s ) . 7 . Repealer. All resolutions and other actions of the Board of Supervisors in conflict with the contents of this Resolution are repealed to the extent of any conflict, on the operative date of the conflicting provisions hereof . Obligations existing under any resolution or other Board action repealed by this section shall not be affected and shall remain in full force and effect. 8 . Effective Date. This Resolution is effective immediately upon adoption subject to any applicable terms and conditions of Ordinance No . 91-40, except that fees imposed herein on development projects (Gov. Code, §66000 ) become effective 60 days after adoption. Orig. Heretofore, the Board of Supervisors has adopted Ordinance No. 91-40 on August 12, 1991 , establishing its policy on the recovery of costs , particularly, the percentage of costs reasonably borne from users of County services and directing staff as to the methodology for implementing said ordinance . 5 . By separate resolution, the Board of Supervisors has or will establish fees for land development applications , permits, inspections , plan checking, map checking and other related services , which fees ( "Development Fees" ) adhere to the policy of the Board of Supervisors, set forth in Ordinance No. 91-40, to recover that percentage of costs reasonably borne, as determined by the Board in said Ordinance. Said fees primarily include fees 'to be charged to development projects (Gov. Code, §66000 ) ; therefore, pursuant to Government Code Section 66017 , shall not become effective until 60 days after passage of the aforementioned resolution. 6 . ' There is an urgent need for the protection of public health, welfare and safety for the immediate increase and establishment of the Development Fees . Similar fees currently in effect are in amounts which are less than necessary to meet the cost recovery requirements of Ordinance No . 91-40 . Therefore, special development services performed are being unfairly subsidized by the general fund. For each day that development services must be provided at rates which do not recover reasonably borne costs , there is an incremental and detrimental affect on the public health, welfare and safety, due to the diversion of funds from general services and programs needed for the public health, welfare and safety. RESOLUTION NO. 91/631 B. URGENCY ADOPTION OF FEES . 1 . Fee Schedule Adoption. Pursuant to Government Code Section 66017 , the fees set forth in Exhibit A, attached hereto and incorporated herein by this reference, are hereby adopted on an urgency interim basis, and shall be charged and collected for the services enumerated therein. 2 . Separate Fee for Each Process . All fees set by this resolution are for each identified process . Additional fees shall be required for each additional process or service that is requested or required.
