SUBJECT: COVERED LOAD REQUIREMENT AT SOLID WASTE FACILITIES
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept this report from the Environmental Affairs Committee.
2 . Direct the Community Development and Health Services Departments
to consider and pursue ways to extend the uncovered load
surcharge requirement now being applied at the Acme Interim
Transfer Station to the Contra Costa Sanitary Landfill
(GBF/Pittsburg facility) and the West Contra Costa Sanitary
Landfill.
3 . Direct the Community Development Department to meet with the
Local Enforcement Agency (Dr. William Walker) regarding the
possibility of extending the uncovered load surcharge to the
Contra Costa Sanitary Landfill.
4 . Confirm the Board of Supervisors' expectation that the Community
Development Department will include off-site litter policing
requirements in new permits for waste disposaland processing
facilities.
5. Direct the Community Development Department, in cooperation with
the County Administrator's Office and Health Services
Department, to work with the Sheriff's Department, appropriate
cities, and the California , Highway Patrol, to assure the
enforcement of covered load and anti-littering requirements in
their respective jurisdictions.
FISCAL IMPACT
The current surcharge of $10. 00 for an uncovered load would result
in a small amount of revenue of the County.

BACKGROUND/REASONS FOR RECOMMENDATIONS
One of the Conditions of Approval for the Acme Interim Transfer
Station requires the imposition of an uncovered load surcharge.
The surcharge was set at $10. 00 per load to encourage compliance.
In addition, on May 14, 1991, the Board of Supervisors amended the
County Ordinance Code to require all waste-carrying vehicles
transporting refuse to solid waste facilities in the County to have
their loads covered.
Since Acme's uncovered load policy want into effect on June 1,
1991, Acme reports that the percentage of uncovered self-hauler
loads has been reduced from about 50% to about 1 to 2% in the first
month, to about . 4% at the present time. Very few parties refused
to pay the surcharge, and turned away. No increase in dumped loads
was observed along Waterbird Way or Waterfront Road in the vicinity
of the facility. If anything, litter decreased along Waterbird
Way, according to Acme.
The Community Development Department recommended to the
Environmental Affairs Committee that the program be extended to the
Contra Costa Sanitary Landfill and the West Contra Costa Sanitary
Landfill. The former lies entirely in the unincorporated area and
the latter's gatehouse is in the unincorporated area. Both are
involved in recent permitting actions. Staff proposes to contact
the operators of the two facilities, and to meet with them, if
necessary. Allowing for program set-up and notification, an
effective date of December 1, 1991, could be achieved. The
Environmental Affairs Committee concurs, and recommends that the
Board direct the Community Development Department to consider and
pursue means to extend the program.
In the case of the Contra Costa Sanitary Landfill, a court
stipulated judgement requires the operator to implement a program
to limit uncovered loads arriving at the landfill, which program is
subject to Local Enforcement Agency (LEA) approval. While the
Committee is aware that approval of any programs is entirely within
the discretion of the LEA, the Committee is very supportive of the
uncovered load surcharge and supports the exploration and pursuit
of such a program at the Contra Costa Sanitary Landfill with the
LEA.
Confirmation of the Board of Supervisors' expectation that off-site
litter policing requirements will be provided in new permits for
waste disposal and processing facilities (Recommendation 4) is
included here because new facilities are in the permitting process.
Recently imposed requirements (e.g. , Acme Transfer Station) are
beginning to be implemented and have become a factor in litter
control.
Cooperation with other jurisdictions (Recommendation 5) is included
here for two reasons. First, the Sheriff's Department and the
California Highway Patrol enforce particular litter control
programs, such as imposing fines for uncovered loads being
transported on public roads. Second, the County's litter control
programs can apply to city streets.
