THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on September 17 , 1991 by the following vote:

SUBJECT: Introduction of the Model Smoking Ordinance
The Board considered the recommendations of the Health Services
Director as presented on the attached report dated September 3 , 1991.
The following persons spoke:
Marvin Ellenberg, Oakland Vending Service, 7677 Oakport, #460,
Oakland, in opposition;
Bill Cody, Bowling Proprietor' s Association and owner of the
Clayton Valley Bowl, in support;
Barbara J. Woodburn, 621 Brackman Lane, Martinez, in
opposition; and
Frank Andronico, a restaurant operator, in support.
Board members considered the comments of several of the speakers
relative to the feasibility of an exemption for remotely controlled
cigarette vending machines by employees of a business where these
vending machines are installed.
Therefore, IT IS BY THE BOARD ORDERED that the issue of remotely
controlled cigarette vending machines is REFERRED to the City/County
Relations Committee for further review.
IT IS FURTHER ORDERED that Recommendation No. 2 on the attached
report is APPROVED.
IT IS FURTHER ORDERED that the Model Smoking Ordinance is
INTRODUCED, reading waived, and September 24, 1991, fixed as the time
for adoption.

SUBJECT: RECOMMENDATIONS TO UPDATE AND STRENGTHEN THE COUNTY SMOKING
ORDINANCE
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I . RECOMMENDED ACTION:
1 . Adopt the attached ordinance entitled Model Smoking
Ordinance to replace the existing Contra Costa County
Smoking Ordinance 87-13 .
2 . Direct the Health Services Department to evaluate the
implementation and effectiveness of the ordinance and
report to the Board of Supervisors and the City/County
Relations Commission in one year with the results of that
evaluation and any recommendations for amendments to the
ordinance.
II . FINANCIAL IMPACT:
None direct. In 1985 an estimated $87 .5 million was spent in
Contra Costa County for medical care of tobacco related
disease.
III . REASONS FOR RECOMMENDATIONS/BACKGROUND:
In 1985 Contra Costa County became the first multi-
jurisdictional county in the United States to adopt uniform
anti-smoking legislation restricting smoking in public places
and in the workplace. Since 1985 additional scientific
evidence has accumulated documenting the health effects of
secondhand smoke among nonsmokers, especially children,
including heart disease and cancer. In light of these
findings the Board of Supervisors (in January, 1991 ) directed
the Health Services Department to review the existing county
ordinance and propose amendments to strengthen the legislation
with the goal of making Contra Costa County smoke-free. The
Health Services Department was directed to consult with the
Public and Environmental Health Advisory Board, the Smoking
Education Coalition, the City/County Relations Committee, the
Mayor' s Conference, and other community organizations and
agencies to develop the widest possible consensus .

At a public hearing on June 18, 1991 the Board of Supervisors
adopted in concept the recommendations from the Health
Services Department and directed the Department to work with
the City/County Relations Committee to develop a uniform
ordinance protecting public health which could be adopted by
Contra Costa County and each of the 18 cities within the
county.
The City/County Relations Committee formed a subcommittee to
develop a final ordinance, which drew key provisions from the
ordinance adopted in concept by the Board of Supervisors, the
Walnut Creek City Ordinance, and the recommendations of the
Coalition for a Smoke-Free Contra Costa. That ordinance was
unanimously approved by the City/County Relations Commission
on August 21, 1991 and is presented for the Board of
Supervisors adoption.
IV. CONSEQUENCES OF NEGATIVE ACTION
Limit the protection provided to Contra Costa employees and
public from the harmful effects of secondhand smoke. Make
addicting tobacco products more readily available to Contra
Costa youth.
