ABSTAIN: None
SUBJECT: Appeal of DeBolt Civil Engineering (Applicant) ,
Michael and Katherine Kell (Owners) from San Ramon Valley
Area Planning Commission denial of application for -Minor
Subdivision 31-83 to divide 1. 98 acres into two parcels.
This being the time fixed for hearing on the appeal of
DeBolt Civil Engineering (applicant) , Michael and Katherine Kell
(owners) , from the San Ramon Vallev Area Planning Commission denial
of application for Minor Subdivision to divide 1.98 acres into two
parcels in the Alamo area; and
Harvey Bragdon, Assistant Director of Planning, having
described the property site and having noted that the variance
request would allow division of a 1. 98 acre parcel into two parcels
of slightly less than 40,000 square feet; and
Katherine Kell, owner, having appeared and urged the Board
to grant the appeal to allow subdivision of the parcel, commenting
that there were already many lots in the area of the same or smaller
square footage and that division of her lot would not adversely
affect the area; and
The Chairman having declared the hearing open and the
following persons having appeared in favor of granting variance:
C.E. Van Bibber, 298 Smith Road, Danville;
Thomas J. Shinault, 201 Smith Road, Danville;
Robert VerSteeg, 147 Cross Raod, Danville;
Gregory J. Coons, 273 Marks Road, Danville;
Teresa P. Coons, 273 Marks Road, Danville;
Jay Bruce Weymouth, 215 Marks Road, Danville;
The following persons having appeared in opposition:
R. W. Morgan, 259 Oak Road, Danville;
Donald E. Love, 332 Marks Road, Danville, Vice President
of the Alamo Oaks Homeowners Association;
Daryl G .Morrow, 163 Cross Road, Danville;
Katherine Kell, owner, in rebuttal, having advised that
provisions would be made for appropriate sewer hook-ups, that there
were already many parcels in Alamo Oaks that do not have horse set
ups, that she was of the opinion that granting the variance
requested would not be precedent setting as there was only one other
property left in the area to be subdivided; and
No one else having desired to speak, the Chairman declared
the public hearing closed; and
Supervisor Schroder having stated that he had visited the
area, and that he was of the opinion that reserving easements for
widening of the road is not appropriate in that widening of the
road would be detrimental to the area and would cause a complete
change in character; and
Supervisor Schroder having advised that because of the
location of the lot and because of the configuration of the roads,
it appeared to him that the granting of the appeal would be
reasonable; and

As recommended by Supervisor Schroder, IT IS BY THE BOARD
ORDERED that the appeal is GRANTED, and application for Minor
Subdivision 31-83 is APPROVED for two lots, subject to the con-
ditions set forth in Exhibit A attached hereto and by reference
incorporated herein.
