HomeMy WebLinkAboutMINUTES - 12201983 - T.5 7-J THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on December 20, 1983 by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson, Schroder NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing on the appeal of Cunha and Associates (applicant) , and Monte and Lucia Albers (owners) , from conditional approval by the County Planning Commission of the Tentative Map of Subdivision 6355, Deer Valley Area. This being the time fixed for hearing on the appeal of Cunha and Associates (applicants) , and Monte and Lucia Albers (owners) , from conditional approval by the County Planning Commission of the Tentative Map of Subdivision 6355, Deer Valley Area; and Harvey Bragdon, Assistant Director of Planning, having described the property site and having advised that the applicants have appealed the conditions recommended by the Public Works Department and approved by the County Planning Commission, and Mr. Bragdon having also advised the Board that revised conditions had been submitted to them for their consideration and that the Planning Department' s recommendation was to approve the conditions which were submitted to the Board in a memorandum dated December 14, 1983; and Supervisor Torlakson having inquired as to what specific recommendations were being made by the Planning Department and the Public Works Department; and Boyd D. Jewett, Assistant Public Works Director, Land Development Division, having advised that the Public Works Department recommendations were approved by the Planning Commission on September 20, 1983, with the addition of an option to contribute funds for Deer Valley Road instead of doing the actual construction or road improvements at this time; and Supervisor Powers having expressed concern over whether there was a necessity for road improvements on Deer Valley Road at this particular time; and The Chairman having opened the public hearing and the following persons having appeared: Lucia Albers, 4773 Laura Drive, Concord (owner) , having appeared and having urged the Board to grant the appeal of con- ditions which were approved by the Planning Commission on September 20, 1983, and to deny the revised conditions submitted by the County Public Works Department; and Daniel A. Duggan, Attorney representing Monte and Lucia Albers having appeared and having requested that the Board grant the appeal of conditions which were recommended by the Planning Department in its November 29, 1983 report, and having stated that there was not a necessity to widen Deer Valley Road for the addition of 5 ranchette type single-family homes, and having commented on the exceptions that have been made in the County policy for other develo- pers in the Deer Valley Area; and Supervisor Torlakson having commented on the fact that in the past exceptions have been made in the County policy, and that he felt .that the Board should look into the legal question surrounding those exceptions, and also stated that after having viewed the subject property he felt that road improvements on Deer Valley Road were not necessary at this time but expressed concern -1- �a 1 , over the fact that improvements may be necessary in the future and that some vehicle should be established to collect the necessary fees for such improvements and having requested that these matters be referred to County Counsel to review the policy questions and the exceptions that have been made in those policies, and having recom- mended that the Board defer this matter to a later date; and Supervisor Powers having stated that he is of the opinion that there is no need for road improvements on Deer Valley Road at the present time and having requested that the Board make a decision on the appeal at this. time; and Supervisor Schroder having commented on the need to have staff review conditions for road improvements, and methods of funding such improvements; and Supervisor McPeak having commented that she rejects the conditions being proposed, the requirements for the frontage road allocation and the method of allocation of funds for Deer Valley Road improvements; and The Board having considered the matter , IT IS BY THE BOARD ORDERED that the hearing on the appeal of Cunha and Associates (appplicants) , and Monte and Lucia Albers (owners) , from conditional approval by the County Planning Commission of the Tentative Map of Subdivision 6355, Deer Valley Area is CONTINUED to January 17, 1983 at 2: 30 p.m. IT IS FURTHER ORDERED that the Board hereby declares its intent to reject the road improvement recommendations made by the County Public Works Department and staff is directed to address the issue of the ultimate road plan.
