Sec 8324) The Board of Supervisors of Contra Costa County RESOLVES THAT: On November 29, 1983, this Board passed a resolution of intention to vacate the County Highway described in Exhibit "A" attached hereto and incorporated herein by this reference and fixed December 20, 1983 at 10:30 a.m. , in its Chambers, as the time and place for the hearing thereon, and ordered that the resolution be published and posted as required by law, which was done as shown by affidavits on file with this Board. The hearing was held at that time and place, this Board hearing and duly considering all evidence offered concerning the vacation by all interested parties. This Board hereby FINDS that the proposed vacation will not have a significant effect on the environment, and that: It has been determined to be categorically exempt under State guidelines Section 15112 in compliance with the California Environ- mental Quality Act. Categorical Exemption, Class 12. The road has been superceded by relocation. The Planning Department having made its General Plan report concerning this proposed vacation and this Board having considered the General Plan, it finds pursuant to Government Code Sec. 65402(x) that it has received the report of the Planning Commission's determination. This Board hereby DETERMINES, pursuant to Streets & Highways Code Sec. 2381, that the vacation area is not useful as a non-motorized transportation facility. This Board therefore further FINDS that the hereinabove described proposed vacation area dedicated to public use, is unnecessary for present or prospective use, and it is HEREBY ORDERED VACATED subject to any reservation and exception described in attached Exhibit "A". 490. 491 --- EXHIBIT "A" Parcel I That parcel of land in the County of Contra Costa, State of California, described as follows: A portion of the Rancho San Ramon, being a portion of the parcel of land described in the deed to State of California, recorded December 8, 1964 in Book 4758 of Official Records at page 23, described as follows: Beginning on a southwesterly line of the parcel of land described in said deed to State of California, (4758 OR 23) at the most southerly terminus of the course given as "having a radius of 280. 00 feet , through a central angle of 460 58' 360, an arc length of 229.57 feet described in PARCEL 1 FIFTH in the deed to Contra Costa County recorded January 30, 1976 in Book 7752 of Official Records at page 426; and running thence from said point of beginning along the southwesterly line of said State of California parcel (4758 OR 23) as follows: Southeasterly along a curve concave to the north whose center bears North 26o 02 ' 12" East with a radius of 280.00 feet, through a central angle of 90 33' 24" for an arc length of 46.70 feet; thence South 730 31' 12" East, 428.64 feet; thence southeasterly along a tangent curve concave to the southwest with a radius of 670 feet, through a central angle of 450 53' 15", for an arc length of 536.60 feet to a point of cusp; thence leaving said westerly line (4758 OR 3) and running North 290 371 50" West, 380.28 feet to the most easterly corner f the parcelof land described as Parcel "A" in said deed to State of California 4758 OR 23 ; thence along the southwesterly linelof said Parcel "A" as follows: North 730 31 ' 12" West, 635.63 feet; thence northwesterly along a tangent curve concave to the northeast with a radius of 220.00 feet through a central angle of 560 32' 00" a distance of 217.07 feet to a point of cusp; thence, leaving said Parcel "A", Southerly along-a curve concave to the east whose center bears North 73o 00' 48" East with a radius of 738.00 feet, through a central angle of 16o 06' 12" for an arc length of 207.42 feet to the point of beginning. County of Contra Costa, State of California, described as follows: A portion of the 'Rancho San Ramon, . being a portion of the parcel of -land described i in the deed to the State of California, recorded December 8, 1964 in Book 4758 of Official Records at page 23, described as follows: i Commencing at a point on the westerly line of the 60.00 foot road right of way known as San Ramon Valley Boulevard, said point bears North 27o 06' 12" West 170.37 feet along said right of way line from the southerly terminus of the course described in "Parcel 1 fifth" as South 270 06' 12" East, 773.80 feet in the deed from Western Electric Company,. RESERVING THEREFROM, pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any highway or part thereof proposed to be abandoned and pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits,. cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and for incidental purposes, including access to protect the property from ali hazards in, upon and over the area hereinbefore described to abandoned.
