On August 13 , 1991, the Board of Supervisor continued to this date consideration of a report from the Director of Community Development. on requested changes in the urban limit line in the County General Plan, and direction to staff . Harvey Bragdon, Director of Community Development, presented the staff report on the matter and commented on a memorandum that had been sent to all of the Board members using the list that had been prepared as part of the presentation at the last meeting, showing the disposition of the list into four categories : 1) those adjustments that should be made due to misunderstandings or activity taking place at the settings; ' 2) the requests around the Byron Airport on which staff recommended action be deferred; 3) those requests that appeared to have no merit for changing the line; and 4) the requests that should be studied further and at the conclusion of the preparation of an environmental impact report and public hearings, the Board could decide if they should be part of an amendment . Victor Westman, County Counsel, clarified that if the Board were to initiate further consideration of changes in the urban limit line, it would only require three votes but that a final decision would require four votes . The Board discussed the process . The following persons presented testimony: Jan Myrana, representing the Lost Valley Homeowners ' Association, presented petitions on the Gateway Valley area remaining open space; Bill Dagle, Vice-Mayor, City of Orinda, requested that the urban limit line remain unmoved; Bobbie Landers, spoke on the Gateway Valley; Leslie Stewart, League of Women Voters of Diablo Valley, spoke on the urban limit line in the Gateway Valley; Fred Etzel, representing Pacific New Wave, requested that local processes be allowed to run their course; Gloria Thomas, spoke in opposition to Pittsburg' s proposal relative to annexation of 1611 acres of open space; . Wayne Thomas, requested that his property being kept out of the urban limit line; Bob Doyle, Assistant General Manager for Advanced Planning and Acquisition for East Bay Regional Park District, commented on letters from the District on the urban limit line; Betty Murphy, resident of Orinda, requested that the Board • delay action; Craig Gunther, representing the West property, spoke on consideration of his request; Pete Wilson, Co-Chairman and founder of SOS Gateway Valley, spoke in favor of the Board changing the urban limit line . The Board discussed the matter. Supervisor Torlakson moved approval of the items listed under category 1 (including 20, 22, 23) with request number 5, the Gateway Zuckerman property to be considered separately, and adding in request number 12 . Supervisor Fanden moved an amendment to include number 5 . Supervisor Powers seconded the amendment . Following further discussion of the amendment, Supervisor Fanden modified her amendment to declare intent to take number 5 out of the urban limit line. Supervisor Torlakson moved a substitute motion to consider the first two items and the Gateway Valley separately. Supervisor Fanden again moved her motion. Supervisor Powers again seconded the motion and clarified that the motion was the amendment to the main motion to express the Board' s intent to exclude the Zuckerman property out from the urban limit line . The vote on the amendment was as follows : AYES : Supervisors Fanden, McPeak, and Powers NOES : Supervisors Schroder and Torlakson ABSENT: None ABSTAIN: None Supervisor Powers clarified that the main motion would be to express to staff to put through the process items, three items which would include the one that intent was just voted on and items 20, 22, 23 , and 12 . Supervisor Fanden removed item 23 . The vote on the motion was as follows : AYES :Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES : None ABSENT: None ABSTAIN: None Supervisor Torlakson moved approval of the recommendations on the Byron Airport Property and the Ralph property (52) and to defer action (number 2 on the sheet including 44 , 45, 46, 47, 48 and 52) . Supervisor Fanden seconded the motion. The vote on the motion was as follows : AYES :Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES : None ABSENT: None ABSTAIN: None The Board discussed the items to be included in Category 4, to direct staff to study the items and include in an environmental document . Supervisor McPeak moved approval of item 3 , the exclusion of 114 acres of UNOCAL land to be included in Category 4 . Supervisor Fanden seconded the motion. The vote on the motion was as follows : AYES : Supervisors Fanden, Schroder, McPeak and Torlakson NOES : None ABSENT: None ABSTAIN: Supervisor Powers Supervisor Schroder moved to include item 6, the Stremel Enterprises 78 acres in the urban limit line, in Category 4 . Supervisor Powers seconded the motion. Supervisor Fanden moved a substitute motion to ask the City of Moraga what their position is on this request . Supervisor Schroder seconded the motion. The vote on the substitute motion was as follows : AYES :Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES : None ABSENT: None ABSTAIN: None The Board discussed the Mission Peak development request (19) . Supervisor Schroder moved and Supervisor Powers clarified the motion to look at the request from an environmental review point along with the UNOCAL project . Supervisor Fanden seconded the motion. Supervisor Schroder requested clarification that the issues before the Board are requests from the property owners who are desirous of going through the process . Supervisor Powers clarified that Category 4 includes those applications that have some apparent justification which could be explored more deeply in an environmental impact report . The vote on the motion was as follows : AYES : Supervisors Fanden, Schroder and Powers NOES : Supervisors McPeak and Torlakson ABSENT: None ABSTAIN: None The Board discussed request number 26 from Mr. Ron Nunn. The Nunn proposal also included numbers 27 and 28 in the adjustment . Supervisor Torlakson moved inclusion of the Nunn proposal in Category 4 . Supervisor McPeak seconded the motion. The vote on the motion was as follows : AYES :Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES: None ABSENT: None ABSTAIN: None The Board discussed request number 30, S .H. Cowell . Mr. Nat Taylor, representing the S .H. Cowell Foundation, commented on the request . Supervisor Schroder moved the recommendation to place this request in Category 4 . Supervisor Fanden seconded the motion. The Board discussed possible development on the property. The vote on the motion was as follows : AYES : Supervisors Fanden, Schroder, McPeak and Powers NOES : Supervisor Torlakson ABSENT: None ABSTAIN: None The Board discussed a request within the City of Walnut Creek (50) . Supervisor McPeak moved to request the City of Walnut Creek' s position on this matter. The vote on the motion was as follows : AYES :Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES : None ABSENT: None ABSTAIN: None Supervisor Schroder moved that request number 15 be included in Category 4 . Supervisor Fanden seconded the motion. Supervisor Schroder moved to include the request . The motion died for lack of a second. Supervisor Powers moved to include the balance of the issues which were approximately 32 requests in Category 3 which is not to study them and include the requests that were voted down in Category 3 . Supervisor Torlakson seconded the motion. Supervisor Powers also included requests number 1, 2, and 4 in Category 3 . (415)362-0757 Fax.(415)254-2462 September 5,' 1991 RLECEIVED VIA FACSIMILE .SEP 61991- Board of Supervisors CLERK BOARD OF SUPERVISOR Contra Costa County CONTRA COSTA CO. 651 Pine Street Martinez, California 94533 Re: Request to Defer Action on Changing Urban Limit Line Pending Orinda City Council Action on the Gateway Valley 90/10 Plan Dear Chairperson Powers and Members of the Board: At your meeting on September 10, 1991, you will be considering a citizen request to change the Urban Limit Line (11ULL11) , as established by "The 65/35 Contra Costa County Land Preservation Plan" adopted by the voters of Contra Costa County this past November, 1990, as it relates to approximately 137 acres of land owned by Pacific New Wave (11PNW11) located on the west side of Orinda in the Gateway Valley. This request is not supported by either the City Council of Orinda, or by Pacific New Wave Corporation (11 PNW11) At its meeting of April 23 , 1991, the City Coun- cil formally declined to support this request. This posi- tion was communicated by a letter (copy attached) dated June 3 , 1991 from Mr. Tom Sinclair, Orinda City Manager, to Mr. Val Alexeeff, Director, Growth Management and Devel- opment Agency, in direct response to the latter's inquiry as to the position of the Orinda City Council on this citizen request. CC: &arcj C,,D ID G- M EZ14 GA020168.02 56/21/02 Board of Supervisors September 5, 1991 Page 2 PNW respectfully requests the Board to leave the ULL as it was originally formulated and proposed by you to the voters of Contra Costa County and adopted by them in No- vember, 1990. You will recall that the ULL on the west side of Orinda was drawn by County Planning staff, including Den- nis Barry, in consultation with City of Orinda staff, in- cluding Wayne Rasmussen, then Orinda Deputy City Manager for Advanced Planning. PNW believes that there is no substantial evidence in the record that would support the Board making any of the findings which are required to change the ULL, and which are set forth in Section 4.B(7) of The 65/35 Contra Costa County Land Preservation Plan. These 137 acres are part of a larger parcel of approximately 1, 000 acres owned by PNW and located on the west side of Orinda in the area known as the Gateway Valley. Most of these lands are within the incorporated limits and the Sphere of Influence ("SOI") of the City of Orinda, which are coterminous. The balance of our lands, approximately 217 acres, lie outside of the SOI and Corporate Limits. Of these 217 acres, approximately 80 lie outside of the ULL. The remaining approximately 137 acres all lie inside the ULL. On June 11, 1991, PNW submitted to the City of Orinda a plan for the conservation and development of this 1, 000 acre parcel. PNW proposes that approximately 90% of our total holdings be permanently preserved as open space, and that approximately 10% of our lands be developed, hence we have named our plan the "Gateway Valley 90/10 Plan. " These 217 acres are specifically discussed in Section 5.4. 1 of the 90/10 Plan. As to the 80 acres outside of the ULL, the 90/10 Plan proposes that they remain in their natural state, and that PNW construct a ridgeline trail to link the City of Orinda to the east with Round Top Regional Park to the west. GA020168.02 56/21/02 Board of Supervisors September 5, 1991 Page 3 As to the 137 acres within the ULL, the 90/10 Plan proposes that they be used for recreation uses, specifically holes 5 and 6 of a proposed 27 hole golf course which is proposed for affiliation with the University of California, Berkeley. A portion of these 137 acres would . be used for the right-of-way for a two-lane Gateway Boulevard, which is consistent with the County Road Network adopted by the Board of Supervisors in January of this year as part of the new Contra Costa County General Plan. Please note that neither of these uses, golf course and Gateway Boulevard, is "development" within the meaning of Section 3 . 6 of the Land Use Element the Supervisors adopted in January of this year as part of the new Contra Costa Coun- ty General Plan. The 90/10 Plan also states that PNW intends to request the City of Orinda to petition Contra Costa County LAFCO to approve the annexation of these 217 acres to the City of Orinda. PNW proposes annexation of these lands to the City of Orinda for the following reasons. Annexation to the City of Orinda would provide for regulatory continuity. In other words, along with develop- ment permits for the remaining 25 golf course holes, PNW would obtain. permits from the City for the development of golf course holes 5 and 6. This same logic would apply to the grading of Gateway Boulevard south to the PNW property line. Also, annexation to the City would facilitate their management by the Orinda Local Land Trust, which is proposed by the 90/10 Plan to manage the open space lands which will be permanently dedicated by PNW. On March 18, 1991, representatives of PNW met with Dennis Barry to discuss the ULL as it related to the 90/10 Plan which was then in preparation. Among the topics raised by PNW with Mr. Barry was the possibility that subsequent to final City action on the 90/10 Plan, the City of Orinda, PNW, or both may petition the Board of Supervisors to change the ULL in the Gateway Valley. This change could be made inci- dent to the execution of a preservation agreement between the County and Orinda, as provided by Section 4 .B(7) of the 65/35 Contra Costa County Land Preservation Plan. This possibility was not included in the 90/10 Plan submitted to the City in June, 1991, but it will be included in the next amendment of the Plan. Subject: Proposed Changes in Orinda' s Urban Limit Lines Through conversations by one of our League members with the offices of Supervisors Fanden and McPeak, as well as an August 14th article in the Contra Costa Times, it is our understanding that the Board of Supervisors is seriously--and favorably-- considering a change in Orinda' s urban limit line in the Gateway Valley. The League of Women Voters of Diablo Valley is opposed to this change and believes that your favorable attitude toward it may be the result of having been given one-sided information. Therefore , we suggest the following reasons why we think this urban limit line should not be changed: 1 . If the 120 acres in question remain inside the urban limit line , the property owner and proposed developer, Pacific New Wave , has promised Orinda that this land will be placed into public trust, so that it will remain open space perma- nently,. If you place it outside the urban line , it is pos- sible that sometime in the future its designation could again be changed and it would be subject to development . 2 . Putting land, which is already guaranteed to be left as open space , into Measure C' s 65% category will not add any addi- tional open space to our county. It would, however, make it possible for prime agricultural land somewhere else to be subtracted from present open space and moved inside some other city' s urban limit line for purposes of development , thus making possible a net loss of open space in Contra Costa. To borrow Supervisor Torlakson' s remark at your August 13th meeting, this also falls into the category of being a "shell game. " 3 . Pacific New Wave says it intends to use part of this 120 acres for one and a half holes of a planned . golf course , while another part of it sits astride the CalTrans right of way, which some day may be needed for a Gateway Blvd. The Diablo Valley League has strong positions on this right of Alamo • Antioch • Bethel Island • Brentwood • Byron 1 Canyon # Clayton + Concord • Danville • Diablo • Lafayette Martinez • Moraga • Oakley 0 Orinda ' Pacheco • Pittsburg ' Pleasant Hill • Rossmoor • San Ramon • Walnut Creek way, based on separate studies by its Orinda and Moraga members. These studies resulted in positions supporting " . . .preservation of potentially necessary rights of way for possible future transportation corridors" and the construc- tion of " . . . a new road through the Gateway Valley. " 4 . If the Board of Supervisors interferes in this issue of Orinda' s urban limit lines, you will be overriding a plan- ning process which has been going on for the past three years . The Diablo Valley League strongly supports "Better coordination between the planning agencies of the County and those of the cities for planning of unincorporated areas which are within the spheres of influence of the incorpor- ated cities . " We also support "effective intergovernmental cooperation. " We believe that a Board decision to change the designation of these 120 acres violates these concepts. Last January 7th, our past president wrote you a letter expressing the thought that when the voters passed Measure C- 1990 , they were expressing their faith in your fulfilling the intent of this plan to preserve open space , manage growth wisely, and do what is right and best for the whole county rather than one special interest or another. The League of Women Voters of Diablo Valley believes that removing these 120 acres in the Gateway Valley from within Orinda' s urban limit line is an empty gesture which accomplishes nothing of value . Bragdon Director of Community Development Re: Report on Requested Changes in the Urban Limit Line in the County General Plan Dear Mr. Bragdon: We are now in possession of the recommended agenda outline of the REPORT ON REQUESTED CHANGES IN THE URBAN LIMIT LINE IN THE COUNTY GENERAL PLAN, dated August 7, 1991 and unsigned. The Board of Supervisors has failed to notify ALL landowners of scheduled meetings. At the last meeting, held on August 7, 1991, it was obvious that at least one concerned landowner was aware of that meeting, affording that party time to prepare and type their arguments to be presented to the Boa rd. We were not notified of this meeting and therefore did not attend. We do understand, however, that the City Manager's assistant, Ms. Lillian Pride, announced that the landowners who wanted in the new proposed city limits were in and that the landowners who wished to remain unincorporated, that is, no change in the status of their land, could remain the same. Is this understanding correct? Your immediate respond clarifying this would be greatly appreciated. We also wish to point out a blaring omission on the attachments to the Report on Requested Changes in the Limit Line in the County General Plan, labeled Figure 1. Our property is located in Parcel 13. The "Comments" section is left blank. For the record, it should be noted that we do not wish to have the status of our land changed. Martinez, CA 94553 Re: Urban Limit Line Change Requests (GPA #11-91-CO) Dear Mr. Bragdon: The East Bay Regional Park District has reviewed the August 7, 1991 Report on Requested Changes in the Urban Limit Line in the County General Plan and offers the following comments. The District understands that the County is currently conducting a comprehensive review of the Urban Limit Line (ULL) including numerous requests to bring specific open space and agricultural parcels inside the line. The County established the ULL together with the 65/35 Land Preservation Plan to protect open space. The criteria for locating the ULL included consideration of open space, parks and other recreation areas. The majority of the requested changes would bring lands inside the ULL. Thousands of acres of open space and agricultural lands would be affected, many acres of which are adjacent to existing regional parklands and to resource areas identified in the District Master Plan (1989). The District is concerned that such changes to the ULL would have both individual and cumulative impacts on regional parkland and important open space. Two specific areas that are proposed for inclusion within the ULL are adjacent to District parklands. No. 13 (S.Anthony Donato/Pittsburg) is 1,611 acres adjacent to the District's Black Diamond Mines Regional Preserve and includes the historic Nortonville area. Request No. 11 (Ronald Gatti/Bollinger Canyon) is 3,660 acres adjacent to the District's Las Trampas Regional Wilderness. Las Trampas is part of a vast open space network that provides significant wildlife habitat, natural resources and unique natural features. These are just two examples of potential impacts on District parklands. Additionally, both of these large areas are isolated from existing services and inappropriate for future urban services. Measure AA criteria for prioritizing acquisitions included lands that are are designated for protection in City and County General Plans. A firm ULL is critical to the District's ability and the ability of local jurisdictions to fulfill the voter mandate to acquire and protect open space. By changing the established ULL, thousands of acres of land may be considered for urban development, impairing the ability of the District and other public agencies to effectively implement the Measure AA acquisition program. The District requests that the Board of Supervisors not proceed with any changes that would bring existing open space lands inside the established ULL. Should the Board decide to consider these changes further, the District supports the staff conclusion that the changes constitute amendments to the adopted County General Plan, and as such, require a supplemental environmental impact report (SEIR).
