THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on September 10, 1991 by the following vote:
AYES: Supervisors Schroder, McPeak, Torlakson and Powers
NOES: None
ABSENT: Supervisor Fanden
ABSTAIN: None
SUBJECT: Kensington Roads Improvement Assessment District 1991-1
The Chair convened the hearing fixed by the Board for this
time by its Resolution 91/504 adopted August 6, 1991.
Michael Walford, Public Works Director, provided the history
and background and the scope of the proposed district, the local
support and the proposed method for funding same.
The Chair declared the hearing opened, and the following
persons appeared:
Julian Block, 19 Franciscan Way, Kensington, appeared in
protest.
Natalie Salsig, 8 Anson Way, Kensington, President of the
Kensington Improvement Club, read a September 9, 1991 letter from the
Improvement Club setting forth concerns and conditions under which the
Club would support the Assessment District, including a request that
the formation be put to an advisory vote of the Kensington electorate.
Geraldine Brochier, 31 Rincon Road, Kensington, agreed with
Ms. Salsig, and suggested that the assessment district be based on the
property value rather than per parcel, and urged that everybody in
Kensington be allowed to voice their vote on whether to have an
assessment district.
Eugene Naccarini, 259 Willamette Avenue, Kensington,
appeared in favor of having the streets done.
J. David Hertzer, 35 Ardmore Road, Kensington, advised that
he had drafted a protest form and delivered it to about two thirds of
the households in Kensington because the notice that the County sent
out did not have any kind of form for reply and he thought it an
unreasonable hardship on people to have to draft their own response.
He urged an advisory vote on the formation of the proposed District,
commenting that he was of the opinion that there is no urgency to the
road rehabilitation.
Anthony Knight, 234 Willamette Avenue, Kensington, immediate
past president of the Kensington Improvement Club, advised that he
wished to speak in support of the project, but shared concerns voiced
in the letter from Natalie Salsig, the current KIC president, and
urged the compilation of a comprehensive proposal and making it
available to Kensington residents.
Peter Hughes, 7 Yale Circle, Kensington, member of the Board
of Directors of the Kensington Property Owners Association, advised
that the community does support the improvement of its infrastructure,
and submitted a summary sheet from the responses to the survey.
Ann Maria Celona, 429 Coventry Road,. Kensington, a member of
the Board of Directors of the Kensington Improvement Club, expressed
support of the concerns set forth in the letter read by Natalie
ti
Salsig, and in addition, advised that she wished to draw the Board' s
attention to the considerable skepticism with .which she and many of
. her neighbors view the County' s ability to implement any version of
the proposed road repair project as it has currently been described.
She commented that the skepticism stems in a large part from the very
recent experience with the Landscape Assessment District.
Clayton Axelrod, 721 Coventry Road, Kensington, ,spoke in
opposition to the road improvements, suggesting that the money could
be put to better uses, such as the schools.
Wolfgang S. Homburger, 280 Columbia Avenue, Kensington,
spoke .in opposition, suggesting the automobile should pay for itself
out of auto generated funds, and suggesting a regular election rather
than a survey to the homes.
Lawrence Rugaard, District Manager of the Stege Sanitary
District, E1 Cerrito., expressed concern with respect to the cost of
raising manhole covers and lowering sewer lines and reconstruction of
lateral sewage lines and requested that those costs be included in the
assessment district.
Edwin LaPaase appeared and advised that he had (earlier)
sent in a written request not to protest the assessment, but to
express the concern of the people on his street (Highgate Court) ,
essentially a non-dedicated street, which the people on the street
every 5 or 6 years have to chip in and have repairs done to the
blacktop. He inquired how many non-dedicated streets there are in
Kensington.
Michael Walford responded that he had worked with the people
on the private streets and had advised them that they could form zones
within the District to just assess themselves for whatever cost is
necessary in order to bring their street up to the public standard
necessary to get it accepted for public maintenance, but none had
committed to do that.
Chairman Powers noted that there were no further requests to
speak, and declared the public hearing closed. He advised that there
appeared to be further work to do on the proposal, including the
concerns of the Stege Sanitary District, and making sure that the
commitment of the County as well as the citizens is well defined. He
suggested that the matter be put on the June 1992 ballot for an
advisory vote.
Robert Brunsell, Bond Counsel for the project, suggested
that the matter be continued to a date certain so that everybody knows
when the matter will come back to the Board, and to avoid having to
send a mailed notice to all of the properties in this 2300-lot
district.
On motion of Supervisor Powers, IT IS BY THE BOARD ORDERED
THAT County Counsel is DIRECTED to prepare an advisory measure to be
put before the Kensington electorate on the June, 1992 ballot, and the
decision on this matter is DEFERRED to June 16, 1992.
On motion of Supervisor Torlakson, IT IS FURTHER ORDERED
that the matter is REFERRED to the Transportation Committee for review
and evaluation and consultation with Public Works on the issues raised
at this hearing.
