G. Wingett, County Administrator, a December 19, 1983, report on the proposed 1984 Legislative Program for Contra Costa County (copy of said report attached hereto and by reference incorporated herein) , and recommending its adoption; IT IS BY THE BOARD ORDERED that the 1984 Legislative Program is hereby ADOPTED. De Re: 1984 Legislative Program The following is a recommended Legislative Program for 1984 for Contra Costa County. At this point, I am recommending general positions on some issues so as to provide staff some direction in supporting or opposing specific bills, In other instances, I am recommending that you sponsor specific legislative action which is of concern to this County. 1 , Project Independence I recommend that your Board endorse Project Independence and other similar proposals insofar as they constitute: (1 ) an effort to stabilize local government's revenue sources, or (2) reduce or eliminate categorical funding of health and welfare programs in favor of having available additional discretionary revenue, or (3) limit the ability of the Legislature to impose State mandates on local government without funding those mandates. I recommend that your Board go on record as favoring legislative solution through passage of appropriate statutes and/or constitutional amendments to be placed on the ballot, but that your Board also endorse efforts to undertake an initiative drive for either an initiative statute or initiative Constitutional Amendment if it appears that the Legislature will not act in a timely and responsible manner. 2. Marshal--Sheriff Consolidation I recommend that your Board seek legislation that would provide your Board with the option of consolidating the bailiff, warrant and process services of the Marshal and the Sheriff in either the Marshal or Sheriff's Office. This should be local option authority applicable only to this County and effective only upon adoption by your Board of an Ordinance detailing the transfer. Senator Boatwright has agreed to carry such legislation. 33 Board of Supervisors December 19, 1983 Page 2 3. Court Reporter Salaries I recommend that your Board seek legislation that would delegate to your Board the authority to set the salary for Superior Court reporters. Government Code Section 73348 sets the salary of Municipal Court reporters. County Counsel points out that while the Legislature can delegate to your Board the authority to set the salary for Superior Court reporters, the Legislature does not have the same right to delegate to 'your Board the authority to set the salary of Municipal Court reporters. In an attempt to streamline this process, I am recommending the following changes in current legislation: A. Delegate to your Board the authority to permanently set the salary rate of -Superior Court reporters by amendment to Government Code Section 70047. B. Fix the salary of Superior Court and Municipal Court reporters pro tempore at the daily rate equivalent to the second step of the salary for permanent full-time reporters in their respective courts. C. Provide that in civil cases the litigants are responsible for the cost of the court reporter after the first day of trial . Senator Boatwright has also indicated a willingness to carry this legislation. 4. Temporary Court Commissioner I recommend that your Board ask the Legislature to create the position of temporary Municipal Court Commissioner for Contra Costa County, but allow appointment only upon approval by the Board. 5. Failure to Appear I recommend that your Board seek legislation which would require the DMV to withhold registration of a vehicle when the vehicle or its owner has outstanding a delinquent moving traffic citation in lieu of the court's issuing an arrest warrant (also endorsed by the Alameda County Board of Supervisors). 6, Fee for Tiling Assessment Appeals I recommend that your Board seek legislation which would authorize the Board of Supervisors to impose a fee for the filing of an assessment appeal (also endorsed by the. Alameda County Board of Supervisors). 3 r� 33 Board of Supervisors December 19, 1983 Page 3 7. Composition of Assessment Appeals Boards I recommend that your Board seek legislation which would authorize the Board of Supervisors to appoint a 5-member Assessment Appeals Board, any three of whom shall serve from time to time as assessment appeals board hearing panels. 8. Housing Commissioners serving on Planning Commissions I recommend that your Board seek legislation which will clarify that advisory commissioners -may at the same time serve on a Planning Commission, 9. Demand for Appearance at County Seat on Traffic Infractions I recommend that your Board seek legislation which would repeal Vehicle Code Section 40502(b). Assemblyman Baker has indicated that he is willing to carry this bill . (Also endorsed by the Alameda County Board of Supervisors) 10. Stipends for Members of Advisory Housing Commissions_ I recommend that your Board seek legislation which would authorize the Board to pay stipends to members of Advisory Housing Commissions, 11. Compensation for Members of Board of Sanitation District 7A I recommend that your Board _seek legislation which would authorize all local elected officials to receive the full compensation provided for in law. 12. Hospital Security Guards I recommend that your Board seek legislation which would authorize security guards at County Hospital to apprehend mental health "runaways" off hospital grounds. 13. Retirement System I recommend that your Board seek legislation which would authorize employees coming to Contra Costa County with reciprocal retirement rights elsewhere to enter our retirement system at the higher level , or Tier I. 14, Candidates' Statements I recommend that your Board seek legislation which would authorize a candidate to include his or her picture in the candidates' statement. 338 Board of Supervisors December 19, 1983 - Page 4 15. Nursing Homes/Medi-Cal I recommend that your Board seek legislation which would help to prevent the involuntary transfer of Medi-Cal patients between skilled nursing facilities. 16. Money Owed the County I recommend that your Board seek legislation which would require the State to pay money owed to local governments in a timely fashion. 17. Municipal Court Pay and Staffing Bill I recommend that your Board ask Senator Boatwright to introduce a municipal court pay and staffing bill for calendar year 1985 into which some of the above items could be incorporated. 18. Phlebotomist--Authority to Draw Blood I recommend that your Board seek legislation which would add to Vehicle Code Section 13354 authority for a "phlebotomist employed by a licensed clinical laboratory" to withdraw blood in drunk driving cases in addition to other persons already specified in this section. 19. Work Furlough Transfers Between Counties I recommend that your Board seek legislation which would authorize a person imprisoned in one county to apply for transfer to the work furlough program in the county in which he resides. Current law allows the transfer only to the county in which the person is employed. 20. Fee for Civil Process I recommend that your Board seek legislation which would authorize an increase in the fee charged for serving civil process to more nearly cover actual costs. 21 . Streamlining I recommend that your Board seek legislation designed to remove from current statutes requirements which unnecessarily increase administrative costs, or which require procedures or processes which are outmoded or inefficient. Irecommend that your Board authorize the County Counsel , at the request of the County Administrator, to draft proposed legislation on any or all of these issues, and that your Board authorize my office to seek authors for these measures; -seek introduction of bills to accomplish these objectives; and authorize my office, and any appropriate County staff, to provide testimony 339 Board of Supervisors December 19, 1983 Page 5 in support of the positions established by your Board on these measures. Finally, I recommend that your Board authorize my office to plan to seek introduction of any of these measures at the 1985 Session of the Legislature to, the extent we are unsuccessful in doing so at the 1984 Session, Respectfully, 7,, M.
