HomeMy WebLinkAboutMINUTES - 09101991 - 1.68 TO: BOARD OF SUPERVISORS Contra f FROM: Phil Batchelor, County Administrator Costa- .;g September 5, 1991 �'�,.,_ -_ ,P4� County DATE: coUN FEDERAL LEGISLATION TO CREATE A COMMISSION ON SUBJECT: INTERGOVERNMENTAL MANDATE REFORM SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: Endorse the 'efforts. of the Suffolk County (N.Y. ) County Executive to identify unnecessary federal mandates which, if repealed, would result in savings to state and local governments, with little or no impact on the federal government. BACKGROUND: The Boardof Supervisors has received and referred to this office a letter from the County Executive of Suffolk County, New York, Patrick G. Halpin. Mr. Halpin points out the extent to which federal mandates are imposing increasing_ demands on suburban counties throughout the United States and thereby result in a form of taxation because of the need to provide funding for all of these mandates. Mr. Halpin proposes the creation of a federal Commission on Intergovernmental Mandate Reform. The purpose of the Commission would be to: 1 . Review all federal rules, regulations, laws and statutes and establish a list of all federal mandates imposed by such measures on state and local governments. 2. -Seek to identify no cost/low cost federal mandates which may be rescinded with resultant savings to state and local governments without impacting the federal government. Recommend the rescission, reduction and relief of specific federal mandates. 4 . Recommend methods of reforming the federal mandate system so as to attain tax relief for federal, state and local tax payers. It is proposed that the Commission be bipartisan and be appointed by the President, the Speaker of the House of Representatives, and the Senate Majority and Minority Leaders. The members of the Commission would include representatives from the following organizations; * National Governors ' Association * National Conference of Mayors * National Association of Counties * Commission on Intergovernmental Relations The Commission would be charged with submitting a report of its recommendations annually. The formation of such a Commission would appear to be consistent with efforts made by the Board of Supervisors in the past to address the problems of mandates at the state level. In addressing state mandates, it often becomes obvious that many of the mandates are effectively dictated from the federal level. The formation of this Commission would attempt to identify cost-effective ways of eliminating mandates which would result in a savings to local and state governments without being disruptive to the federal. government. This appears to be a realistic manner in which to approach federal mandates and would seem to hold a good deal of promise for future cost savings. We are, therefore, recommending that the Board endorse these efforts and ask Congressman George Miller III to consider co-sponsoring the legislation.
