BACKGROUND: The California Constitution currently limits the maximum amount of any ad valorem tax on real property to one percent of the full cash value, except for indebtedness approved by the voters prior to July 1, 1978 or bonded indebtedness for the acquisition or improvement of real property approved on or after July 1, 1978 by 2/3 of the voters voting on the proposition. ACA 6 has been introduced by Assemblyman O' Connell to modify these provisions. As amended June 10, 1991, ACA 6 would do all of the following: 1. Allow an ad valorem property tax to be imposed by a majority of the voters on or after July 1, 1992 for bonded indebtedness incurred by a local government for the construction, reconstruction or rehabilitation of criminal justice facilities, including not only adult detention and work furlough facilities, but also juvenile halls, juvenile ranches and camps and regional youth education facilities. 3 . Specifies that no ad valorem property tax imposed under # 1 or # 2 above would be considered a "special tax" . 4. Specifies that propositions on the ballot pursuant to # 1 or # 2 above require only a majority vote. With the pressing need in this County for a new juvenile hall and other more adequate juvenile detention facilities, the County Probation Officer has asked that the Board of Supervisors join him in supporting the- passage of ACA 6 so that the voters have an opportunity to express themselves on this issue. This office concurs with this request and urges the Board of Supervisors to indicate their support for ACA 6. ' ACA 6 passed the Assembly Revenue and Taxation Committee of March 11, 1991 by a vote. of 7:1.
