SUBJECT: Approve Easement Agreement with the United States of America for Cypress Road
Pedestrian Bridge and Path project.

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE the Pedestrain Bridge Crossing Easement, Contract No. 1-07-20-L5418, with the
United States of America for use of Federal lands as part of the Cypress Road Pedestrian Bridge
and Path project, and Authorize the Public Works Director to execute the easement agreement
to allow construction and maintenance of a pedestrain bridge crossing over Contra Costa Canal.
II. Financial Impact:
The United States through its Department of the Interior, Bureau of Reclamation has waived the
right of use.fee. The administrative charges are $849.69 of which.$200.00 has been deposited.
Funded by Transportation Development Act (TDA) (37%), Road Funds (31.5%) and Oakley Area
of Benefit (31.5%).
III. Reasons for Recommendations and Background:
The Cypress Road Pedestrian Bridge and Path Project requires the construction of a bridge
across the Contra Costa Canal (Milepost 4.42) on Federal Land managed by the Department
of Interior, Bureau of Reclamation. The Contra Costa Water District is the local representative
of the Bureau of Reclamation.

III. Reasons for Recommendations and Background (Cont'd.):
In response to the Public Works Department request for necessary project land rights, the
Bureau of Reclamation has provided a contract granting the rights of way and requiring the
Public Works Department to maintain the new bridge.
IV. Consequences of Negative Action:
Construction of the project cannot proceed on Federal property without execution of the subject
agreement.
