HomeMy WebLinkAboutMINUTES - 08131991 - H.6 H. 6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 13 , 1991 "by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson and Powers NOES: None ABSENT: None ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Rezoning Application 2925-RZ, Final Development Plan 3034-90 And Subdivision 7597, Kaufman and Broad, West Pittsburg Area This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request by Kaufman and Broad (applicant and owner) to rezone 150 acres of land from Agricultural Preserve (A-4 ) to Planned Unit District (P-1) ( 2925-RZ) ; and their request for approval of a Final Development Plan proposing the construction of 299 single family residences and associated improvements in a P-1 zone (DP 3034-90 ) ; and for approval to subdivide 150 acres of land into 299 single family residential lots in four phases of 93 lots,78 lots, 59 lots and 69 lots respectively (Subdivision 7597) in the West Pittsburg area. Karl Wandry, Community Development Department, presented the staff report on the proposed project, describing the site and commenting on the Planning Commission recommendation and the staff recommendations for approval of the project. Mitch Avalon, Public Works Department, commented on the alignment of Driftwood Drive and the entrance to the Calvary Temple property. The following persons appeared to speak: Dudley Frost, La Selva Beach, representing the Shriner ' s Hospital, spoke on the Shriner' s opposition to the project relative to the acquisition of development rights over the 50 acre Shriner property and he presented written comments. Patricia Curtin, Gagen, McCoy, et al, 279 Front Street, Danville, representing Dudley Frost, spoke on legal issues including inconsistency of the project with the Evora Road General Plan Amendment, the mitigation measures and CEQA findings adopted on the General Plan Amendment and the newly adopted General Plan; and she requested that the Board require as a condition of approval the acquisition by the developer of the Shriner property for dedication as open space. Maron Thomas Spahn, 555 Azores Circle, West Pittsburg, spoke in opposition to the proposed project. Karl Boeger, 711 Pacifica Avenue, Pittsburg, presented written material and spoke on concerns including fencing and access. Supervisor Torlakson requested clarification on the access. Mr. Boeger and Mitch Avalon responded to Supervisor Torlakson' s request. Dennis Pisila, Contra Costa Water District, Concord, commented on access concerns including the strength of the siphon, the inconsistency of advisory note L added by the Planning Commission and Conditions 8 and 10 of the rezoning. I Glen Brown, Steadman Associates, Civil Engineer for Kaufman and Broad, commented on agreement with the conditions of approval and spoke on the Boeger access issue and the fencing issue. Supervisor Torlakson requested clarification on participation in the trail system. Vince Fletcher, Kaufman and Broad, responded in agreement to trail participation. Sanford Skaggs, Kaufman and Broad, spoke in favor of the proposal and he commented on the funding of the extension of Driftwood Drive, and the Shriner property. Supervisor Torlakson suggested that the Calvary Temple be used for the child care requirement for the project. Mr. Skaggs expressed Kaufman and Broad' s preference to cooperate with the Calvary Church. Patricia Curtin spoke in rebuttal. The public hearing was closed. Supervisor Schroder commented on the open space and park designations in the project and expressed opposition to a condition requiring the purchase of the Shriner property. Supervisor Fanden expressed concern with requiring the purchase of the Shriner property as a condition of approval. Supervisor McPeak requested clarification on the proposed requested requirement for the purchase of the Shriner property. Mr. Wandry responded to Supervisor McPeak' s request. Supervisor Torlakson moved conceptual approval of the project with a direction to staff to develop conditions of approval to address concerns including the alignment of the road and the driveway for the Calvary Temple, the payment for the water tank, the trail system access, that the second access be subject to a hearing by the Zoning Administrator, the fencing, and the County participation in the extension of Driftwood Road. IT IS BY THE BOARD ORDERED that the Board of Supervisors hereby DECLARES ITS INTENT to approve rezoning application 2925-RZ, Development Plan 3034-90 and Subdivision 7597 as amended; and Community Development Department staff is DIRECTED to prepare the appropriate documentation for Board consideration.
