Contra FROM: Hazardous Materials Commission Costa County DATE: August 13, 1991 ( �` �0", ` SUBJECT: LEGISLATION TO GIVE LOCAL HEALTH AGENCIES GREATER ENFORCEMENT AUTHORITY TO IMPLEMENT HAZARDOUS WASTE LAWS (SB %6) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)A BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1. Accept the report of the Hazardous Materials Commission. 2. Adopt a position in SUPPORT of SB 966 by Senator Bergeson and urge Contra Costa County's legislative delegation to support the bill's enactment. BACKGROUND: SB 966, introduced by Senator Bergeson, would allow the California Environmental Protection Agency to delegate some of its enforcement authority concerning hazardous waste to local health agencies. Although the County Health Services Department currently performs Hazardous Waste Generator inspections under a memorandum of understanding with the State, HSD does not have concurrent enforcement authority. Thus, HSD must rely upon lengthy District Attorney actions to achieve compliance. SB 966 would provide HSD with administrative enforcement authority. To carry out these additional responsibilities, SB 966 would also increase the amount of money that HSD receives from penalties. Current law requires that 50 percent of the funds go to the Hazardous Substance Account in the General Fund of the state, 25 percent to the office which brought the action, and 25 percent to the state to fund activities of the local health officer. Under SB 966, 50 percent would go the city or county that imposed the penalty for deposit into a special account to fund hazardous waste enforcement activities and 50 percent to the state for deposit in the Hazardous Waste Control Account for local health officer activities. This bill is supported by the California Conference of Directors of Environmental Health.
