SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
RATIFY emergency contract with Shyrock Grading Company and approve payment in an
amount not to exceed $65,000 for emergency slide repairs at 361 Kingswood Lane in the Black
hawk area.
II. Financial Impact:
None to County.
111. Reasons for Recommendations and Background:
The Board of Supervisors Resolution No. 86/370 (copy attached) established the procedures
for the award of contracts for repair projects. Paragraph I.D.2. provides for the award of
"emergency contracts in excess of $20,000, but requires that such awards be ratified by the
District Board of Directors. Attached is request for such a ratification, the first ever in the history
of operation of the G.H.A.D.
Right after the heavy rains last March, the District was called by the property owner of 361 Kings
wood Lane, who stated that a major slide had just occurred along his rear bank slope, and that
his rear yard landscaping and swimming pool (and possibly even his house) were threatened
by further sliding. The District Geologist and Construction Administrator visited the site and
confirmed the precariousness of the situation. The District called in two specialist contractors
(one for retaining wall pier drilling and the other for reconstructive grading) and authorized them
to begin work immediately. (See letter of April 18 to the County Public Works Dept. - copy

The reconstruction work was very competently completed and the hillside slope and the
property owner's landscaping and pool are restored and secure. The total cost of the
reconstruction unfortunately exceeded the original estimate of $40,000, because of the need to
provide an interim stabilizing solution as well as a final permanent solution. This 2-step solution
was necessary due to the size and extent of the slide and the time required to construct the
permanent solution, combined with a serious concern that the damaged hillside might have slid
further unless the interim solution was constructed first.
One of the construction contracts (copy attached) was on May 1 to Shyrock Grading Company,
for a maximum cost for the entire grading operations (removal, replacement, and recompaction)
of$65,000. His work was excellently done, and at a very rapid pace, and the Board's ratification
of his contract is requested.
IV. Consequences of Negative Action:
Unable to pay contractor for work already completed.

Dear Contractor:
You are hereby directed to proceed with the following construction
work for repair of the subject land slide: Repair existing slide
per direction of District Geologist.
It is understood that this work is not to exceed $55, 000.00, which
is in addition to previously authorized $10, 000. 00, for a total of
$65, 000.00.
Your work is to be done under the direction of John La Violette,
Staff Geologist, and in accordance with Contra Costa County
Standard Specifications. This work is to be done on a.. "time and
materials" basis at the standard hourly labor and equipment rate
for your 550JD dozer with the operator of $85 per hour. This work
will also be covered by the Workmans Compensation Certificate which
you submitted to us dated June 28 . 1990 and the Insurance Indemnity
coverage, a certification which you also submitted to us effective
May 1, 1990.
Your work should progress in an expeditious manner in order to
coordinate with other construction projects.

Subject: Emergency Slide Repair at 361 Kingswood Lane, Blackhawk (Project B90-26)
Gentlemen:
The rules and regulations which established the Blackhawk Geologic Hazard Abatement District in
1986 allows the approval by the District General Manager of construction repair projects up to
$20,000. They also allow for the General Manager to contract for projects over$20,000 if the repair
is deemed to be an "emergency repair". The subject repair is that type of emergency project.
After the last major rain storms, we were called out to review a slide which had just occurred at the
subject address. Our District Geologist reviewed the situation, which included destruction of some
of the yard's landscaping, the upper scarp of the slide located at the edge of a swimming pool, and
the threat that additional sliding could take place which would further damage (or possibly destroy)
the swimming pool and other yard, or even home, improvements. Due to this emergency situation,
we immediately contacted ENGEO Consulting Geologists, and Bryan & Murphy Civil Engineers, to
devise a "pin-wall" design for installation to hold the hillside from further movement. We also
contacted A & A Marek Drilling to construct the "pin-wall" and Shryock Grading company for their
excavation, replacement, and recompaction of the fill material which had slid to the bottom of the
hill. Our contractors have estimated that the total repair work on this project could be in the range
of $20,000-30,000. Because of the emergency nature of this repair, we have authorized the
contractors to proceed with their work, but wanted to inform you of this situation and the reasons for
our rapid authorizations to proceed with the repair work, in accordance with the Blackhawk District
rules and regulations. We will attach a copy of this letter to the billings from the contractors to
explain to your accounting department the reasons for this special authorization.

The Board of Directors of the Blackhawk Geologic
Hazard Abatement District RESOLVES that:
On April 22, 1986, the County Board of Supervisors
adopted Resolution No. 66/210, approving the formation of the
Blackhawk Geologic Hazard Abatement District (GRAD). On
June 24, 1986, the Board of Directors of the Blackhawk GHAD
adopted,Resolution No. 86/369 providing, among other things,
for the appointment of Mr. Richard A. Nystrom as the initial
General Manager of the Blackhawk GHAD and approving an
Employment Agreement between the GHAD and the General Manager.
Public Resources Code Section 26600 provides that the
Board of Directors may negotiate improvement contracts or may
award such contracts by competitive bidding pursuant to
procedures approved by the Board. Public Resources Code
Section 26601 provides that GHAD improvement work- and all
related activities are deemed to be specific actions necessary
to prevent or mitigate an emergency within the meaning of
CEQA. In order to facilitate the ability of the Blackhawk GHAD
to timely undertake repair, maintenance and improvements as
necessary, it is in the public interest to adopt a set of
procedures for the awarding of contracts for all GHAD repair,
maintenance and improvement projects and for professional and
support services.
NOW, THEREFORE, THE BOARD OF DIRECTORS HEREBY
RESOLVES, FINDS, CERTIFIES AND ORDERS AS FOLLOWS:
The Board hereby adopts the following procedures for
the awarding of contracts for GHAD repair, maintenance and
improvement projects and for professional and support services:

PROCEDURES FOR AWARDING OF CONTRACTS FOR REPAIR,
MAINTENANCE AND IMPROVEMENT PROJECTS AND
FOR PROFESSIONAL AND SUPPORT SERVICES
I. CONTRACTS FOR REPAIR, MAINTENANCE AND IMPROVEMENT
PROJECTS.
Competitive bidding and contract award procedures for
.)istrict repair, maintenance and improvement projects shall be
-implemented as follows:
A. Projects with Defined Scope of Work.
When the scope of work for a particular project can be
clearly defined and readily lends itself to the preparation of
specific plans, specifications and bidding documents, and time
permits, the following procedure shall be implemented:
1. Potential bidders shall be notified of the
_ project as follows:
(a) By written notice to trade journals of
general circulation in the area;
(b) By written notice to local builders'
exchanges; and
(c) By written notice to at least three
contractors licensed in the State of California to do the type
of work being bid.
The written notice shall describe the project in
general terms and how to obtain more detailed information about
the project, and state the time and place for the submission of
bids. All mailing of notices to contractors, construction
trade journals and builders exchanges shall be completed not
less than 15 calendar days before the bids are due..
2. The Contract shall be awarded and executed
by the General Manager based upon the lowest responsible bid
received as a result of the notification procedure specified in
1. above.
3. Prior approval by the District Board of
Directors shall be required for the execution of all contracts
with a value in excess of $20,000.
B. Projects with Undefined Scope of Work.
When the scope of work for a project is undefined and
does not readily lend itself to the preparation of specific
plans and specifications, the following procedure shall be
implemented:
1. Three or more prequalified bidders shall be
notified, either in writing or orally, and shall meet at the
job site for verbal instructions regarding the project and
submittal of bids.
2. Rental rates, such as Caltrans •standard
rates,' may be used as a basis of such bids, with the markup
for overhead and profit to be included in bid.
3. The contract shall be awarded and executed
by the General Manager based upon the lowest combined rental
rate, including overhead and profit percentage.
4. Prior approval by the District Board of
Directors shall be required for the execution of all contracts
with a value in excess of $20,000.
C. Failure to Receive Bids.
If no bids are received after a project is bid under
either procedure A or B above, the General Manager may either
resolicit bids using procedure A or B above, or may negotiate a
contract for the work.
In the event of a negotiated contract, prior approval
by the District Board of Directors shall be required for the
execution of the contract if the total value is in excess of
$20,000.

D. Exceptions to Standard Contract Bidding and Award
Procedures.
1. Contracts less than $10,000 -- the General
Manager may accomplish by negotiation or, at the General
Manager's discretion, by competitive bidding, improvement
contracts with a value of $10,000 or less, provided such
_ contracts are within the District's budgetary limits.
2. Emergencies -- standard contract bidding and
award procedures shall not apply where the project is
necessary, in the reasonable judgment of the General Manager,
to prevent or mitigate an emergency. Emergency contracts with
a value in excess of $20,000 shall be ratified by the District
'board of Directors.
Por the purpose of these procedures only, the
term •emergency' shall include, but not be limited to,
conditions or situations actively causing severe damage to
valuable property or conditions or situations highly likely to
cause such damage or personal injury unless cleanup or
mitigation measures are taken immediately.
II. CONTRACTS FOR PROFESSIONAL AND SUPPORT SERVICES.
A. Contracts for Geotechnical/Soils Engineering
Consulting Services.
The General Manager may accomplish by negotiation or,
at the General Manager's discretion, by Requests for Proposals,
contracts for geotechnical/soils engineering services. Prior
approval by the District Board of Directors shall be required
for all such contracts with a value in excess of $5,000.
B. Contracts for Other Professional and Support
Services.
The General Manager may accomplish by negotiation or,
at the General Manager's discretion, by Requests' for Proposals,
contracts for other professional services (e.g., legal,
accounting, insurance) and for support services (e.g., office
space, office equipment, office staff and vehicles). Approval
by the District Board of Directors shall not be required for
such contracts, provided such contracts are within the
District's budgetary limits for such items.
