HomeMy WebLinkAboutMINUTES - 09251990 - TC.1 TO: BOARD OF SUPERVISORS FROM: TRANSPORTATION COMMITTEE DATE: September 17 , 1990 SUBJECT: Conceptual Approval of Joint Exercise of Powers Agreement for Transpac RECOMMENDATION Approve in concept a draft joint exercise of powers agreement with the member cities of Transpac, subject to technical modifications. FINANCIAL IMPACT If approved by all member jurisdictions, the County's share of the estimated $65, 000 annual costs for hiring of a consultant would be $10, 462 per year. The formula for allocating costs is based on 50% equal shares and 50% proportionate to the return to source funds received by each jurisdiction. REASONS FOR RECOMMENDATION/BACKGROUND Transpac has been meeting for several years under the terms of a Memorandum of Agreement in order to. coordinate transportation planning within the central County area. Members are the Cities of Clayton',' Concord-, Martinez, Pleasant Hill and Walnut Creek and the County. With the passage 'of Measure C, Transpac became one of the four regional transportation planning committees (RTPC) which advises the Contra Costa Transportation Authority. Measure C assigns the RTPC's a major role in the development of action plans for routes of regional significance. In order to formalize its agreement and enable it to hire consultants to assist in meeting the requirements of Measure C, Transpac has developed a draft joint exercise of powers agreement (JPA) and has circulated it to member agencies for review and conceptual approval. This review will be followed by a redraft of the agreement and recirculation to the cities and County for adoption. The agreement should include provisions for filing required notices with the California Secretary of State. 2. Paragraph 7, page 3, entitled Overall Organization should be revised to indicate that staffs or consultants will report to the Transpac TAC. 3. A new section should be added under Paragraph 8 describing the membership and functions of the Planning Committee of Transpac. 4. Paragraph 8(b)(1) on page 4 is not clear regarding who appoints planning commission representatives to Transpac and whether planning commissioners shall have alternates. 5. The JPA should describe the agenda-setting process for Transpac and which items originate from the TAC and/or Planning Committee before being considered by Transpac. 6. In the fifth line of Paragraph 15, page 8, entitled Withdrawal, "Paragraph 11" should be revised to read "Paragraph 13", and the sentence ended at that point. This would remove an inconsistency in the document concerning the timing of payments to the JPA. Paragraph 13 indicates that bills shall be prepared for each calender quarter. In this case no funds would be available for refund in the event of the withdrawal of a member. Transpac\TR002
