REORGANIZATION OF THE COMPOSITION OF THE ECONOMIC OPPORTUNITY
SUBJECT: COUNCIL TO COMPLY WITH STATE LAW, REGULATIONS AND THE
COUNCIL'S BY-LAWS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1 . Adopt the attached Resolution providing for changes in the
composition of the Economic . Opportunity Council (EOC) in
order to conform the EOC with current State law and
regulations as well as with the By-laws of the EOC.
2. Remove this item as a referral to our Committee.
BACKGROUND:
This issue was referred to our Committee on December 19, 1989.
We previously made a report to the Board of Supervisors on this
matter March 6, 1990.
In September, 1989, the State of California' s Department of
Economic Opportunity determined that the Economic Opportunity
Council was out of compliance with its own by-laws. In addition,
the by-laws needed to be revised to conform to the present
requirements under State law.
In the process of revising the by-laws, County Counsel requested
copies of all prior Board Orders adopted by the Board of
Supervisors relating to membership on the EOC. The only record
which could be identified was Resolution 3355 'adopted by the
Board of Supervisors in 1964. By law, the EOC is to be comprised
. of three parts; public sector, private sector and low income

sector. Resolution 3355 is entirely out of date and does not
reflect the current composition of the EOC. In addition, the EOC
currently includes eight public sector representatives: the five
members of the Board of Supervisors or their designees and one
representative each from the cities. of Pittsburg, Richmond and
Clayton.
County Counsel has considerable trouble rationalizing why one
city should be selected to be represented on the EOC over any
other city. County Counsel is, therefore, recommending that the
EOC be comprised of 15 individuals, as follows:
PUBLIC SECTOR:
The five members of the Board of Supervisors or their
designees;
PRIVATE SECTOR:
Five private sector representatives, to be selected by the
board of directors of private sector groups interested in
being represented on the EOC.
LOW INCOME SECTOR:
Five representatives, one from each of the five Head Start
Delegate agencies, selected by the local policy committee.
Adoption of the attached Resolution will put this revised
composition in place, as is reflected in the EOC' s By-laws.

Council )
WHEREAS, the purpose of the Economic Opportunity Council is to
advise the Board of Supervisors on Community Action Programs; and
WHEREAS, California Government Code section 12752.1(a) (1)
requires that the Economic Opportunity Council consist of one-
third elected public officials or their representatives, one-
third persons who represent the poor in the areas served, and
one-third private sector representatives.
NOW, THEREFORE, BE IT RESOLVED that the Economic Opportunity
Council shall consist of one representative for. each of the five
members of the Board of Supervisors- who is to be appointed by
the Board member and who is to serve at the Board member's
pleasure; five persons who represent 'the poor in the areas
served, who are to be elected or selected by local policy
committees of the five Head Start delegate agencies as provided
in the Economic Opportunity Council's by-laws and who are to
serve for a term of two years but for no more than three
consecutive terms; and five private sector representatives, who
are to' be selected by the board of directors or equivalent
decision-making body of private sector groups who are interested
in being represented on the Economic Opportunity Council as
. provided in the Economic Opportunity Council's by-laws and who
are to serve for a term of two years but for no more than three
consecutive terms.
BE IT FURTHER. RESOLVED that this resolution supercedes any
previous resolutions adopted regarding the .composition of. the
Economic Opportunity Council.
