SUBJECT: Heritage Tree Applications
The Board considered the recommendations of Harvey E.
Bragdon, Director, Community Development Department, for approval
of the Heritage Tree application of Dick Hardie (H.T. 4-90 ) for two
Valley Oak trees located on his property at 2061 Strand Road,
Walnut Creek, and the Heritage Tree application of Richard and
Hilary Elkin (H.T. 5-90) , 4143 Santa Rita Road, El Sobrante, for
four native California Black Walnut trees located in their
neighborhood at 4426 Appian Way, E1 Sobrante. (A copy of Mr.
Bragdon' s report is attached and included as a part of this order. )
Hilary Elkin, 4143 Santa Rita Road, E1 Sobrante, spoke about
the beauty of the trees at 4426 Appian Way, of actions (girding or
ring cutting) taken by the owner to destroy two of the trees, and
of procedures (bridge grafting) that would need to be implemented
immediately to reverse any damage to the trees as a result of
girding.
M. P. Boyle, (representing Hugh Afshar, the property owner)
12240 Blythen Way, Oakland, requested the Board to defer action on
application H.T. 5-90 to allow the property owner opportunity to
review this matter further. He expressed concern. with the possi-
bility of the rights of property owners being circumvented by
persons who are not a party of record to a particular parcel of
land but who wish to exert some influence on its disposition.
Hugh Afshar, 671 Ironbark Circle, Orinda, requested the Board
to postpone action on this application to allow him and his attor-
ney time to respond to this matter. He advised of his plans to
construct 18 townhouses on the subject property, and of his compli-
ance with County requirements for improvement of Appian Way which
delayed the construction of his townhouse project. He noted that
because of time spent on the improvements to Appian Way his
construction permits expired. He stated that he did not believe
that at the time of his application for his initial permits that
the trees would be an impediment to his proposed development. Mr.
Afshar advised that he has just received a copy of the County Tree
Ordinance No. 88-83.
Board members discussed the matter and agreed to proceed with
the application of Mr. Hardie, but to defer decision on the appli-
cation of Mr. and Mrs. Elkins.
IT IS BY THE BOARD ORDERED that Heritage Tree Application No.
4-90 of Dick Hardie for two trees located at 2061 Strand Road,
Walnut Creek, is APPROVED.
IT IS FURTHER ORDERED that decision on Heritage Tree Applica-
tion No. 5-90 of Richard and Hilary Elkin for designation of four
trees located at 4426 Appian Way, E1 Sobrante is DEFERRED to
October 23 , 1990 . Community Development staff was instructed to
meet with all parties to seek resolution to the problem.

SUBJECT: Approval of Heritage Tree Applications
H.T. 4-90 (Hardie) and H.T. 5-90 (Elkin)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S ) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Approve the two applications, H.T. 4-90 (Hardie) and H.T.
5-90 (Elkin) as recommended by the County Planning Commis-
sion, in accordance with Ordinance #88-83 .
2 . Direct the Community Development Department to officially
register the designated heritage trees.
3 . Direct the Building Inspection Department to adopt measures
to preserve the designated trees in accordance with . Ordi-
nance #88-83 .
BACKGROUND
In accordance with the ordinance on Heritage Tree Preservation
District (Ordinance #88-83) , two. applications were received by
the Community Development Department.
On July 11, 1990, application #H.T. 4-90 was submitted by Dick
Hardie, requesting "heritage tree" designation of the two Valley
Oak trees located on his property, 2061 Strand Road, Walnut
Creek.
On July 16, 1990, application # H.T. 5-90 was submitted by
Richard and Hilary Elkin 'of 4143 Santa Rita Road, E1 Sobrante,
requesting that the four native (California Black Walnut) trees
located in their neighborhood at 4426 Appian Way (APN 425-210-038
and 425-210-014) E1 Sobrante, be designated as heritage trees in
accordance with Ordinance #88-83 .
After a public hearing on August 28, 1990, for each of the two
applications, the County Planning Commission recommended approval
.. of both .the applications.

It is recommended that the Board of Supervisors accept the
recommendation of the County Planning Commission, approve the
subject applications and designate the trees identified therein
as heritage trees.
It is further recommended that the Community Development Depart-
ment be directed to officially register the designated trees and
the Building Inspection Department be directed to adopt the
necessary measures to preserve the designated heritage trees in
accordance with Ordinance #88-83 .
