Contra �aE .......... ar FROM: PHIL BATCHELOR CostaCounty Administrator DATE: September 6, 1990 ^o.. .•�r County SUBJECT: FINE AND FORFEITURE DISTRIBUTION AGREEMENT FOR PHOTORADAR CITATIONS Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: Authorize .the Director of Justice System Programs to execute an agreement with the Town of .Danville regarding processing of traffic citations issued using photoradar technology. FINANCIAL IMPACT: None anticipated at this . time. Data processing costs necessary to modify the Municipal Courts Automated Minor Offense Reporting System to handle these citations will be reimbursed from an adjustment on the fines and forfeitures collected on these citations. Purpose of program is deterrence; not revenue enhancement. REASONS FOR RECONMENDATION/BACKGROUND: The Town of Danville is implementing a program whereby moving trafficcitations will be issued using photoradar technology. These citations will require special processing at the Municipal Courts from the moving traffic citations that are currently .processed. . This agreement would provide a funding basis for these changes. As a deterrent to speeders in residential areas and to improve the safety of children in .school zones, the Town of Danville is implementing a program whereby moving traffic citations will be issued using photoradar technology. As part of this program, special tracking of the citations will be done via the Municipal Courts' Automated Minor Offense Reporting System. To reimburse the County for this special processing development costs and for ongoing operations at the Municipal Courts, the Town of Danville has agreed to a modification of the fines and forfeitures distribution on citations issued using photoradar technology. Further, the Town of Danville has agreed that in instances where a .defendant fails to clear one of these citations, the City Attorney's Office will'prosecute the matter. rather than the District Attorney.
