Approve Agreement for Legal Services with Nancy Miller of the law offices of Hyde, Miller and Savage. 2 . Authorize the Board Chair to sign Agreement on behalf of Contra Costa County. FINANCIAL IMPACT: Cost will be paid out of the General .Fund, which will be reduced unless the City of Pleasant Hill reconsiders it'..s decision to keep all tax increment derived from the area through the year 2032 . REASONS FOR RECOMMENDATION/BACKGROUND: The City of Pleasant Hill plans to amend its Pleasant Hill Commons Redevelopment Project. The existing redevelopment plan has a $52, 000, 000 tax increment cap. The amendment would increase the cap to $346 , 000, 000 and extend the life of the cap for two years to the year 2032 . The -County, along with other affected taxing agencies, has recently concluded Fiscal Review Committee hearings . At those hearings, the Pleasant Hill Redevelopment Agency made it clear that it does not plan to share any of the tax increment it will derive from the amendment with the County or any other affected taxing entity. County staff calculates that both increased costs and lost revenues will result from the project amendment, resulting in substantial financial burden or detriment in excess of $116, 000, 00O. over the life of the project. The amendment to the Pleasant Hill Commons Redevelopment Project is scheduled for adoption in November, 1990 . The County requires the services of Hyde, Miller and Savage to challenge the amendment at the time of adoption and, if the agency remains firm in its decision not to share increment, to initiate legal action. The County also requires the services of Hyde, Miller and Savage to evaluate whether the City has properly compiled with the California Environmental Quality Act (CEQA) and to take whatever action is necessary to ensure compliance.
