SUBJECT: Marsh Canyon Development Agreement Referendum
The Board on September 11, 1990 deferred decision to
this date on the referendum petition against Ordinance 90-49, the
Marsh Canyon Development Agreement.
Victor J. Westman, County Counsel, advised that pursuant
to Elections Code Section 3754 the Board was required to take one
of three alternative actions:
1) Repeal Ordinance 90-49;
2 ) Call a special Countywide election; or
3 ) Submit it to the voters at the next regularly scheduled
Countywide election which will occur in June 1992.
Wilbert E. Cossel, 16711 Marsh Creek Road, Clayton,
urged the Board to rescind the ordinance and allow the electorate
to make the decision on the Marsh Canyon site.
Brian Kruse, 18201 Marsh Creek, Brentwood, urged the
Board to rescind the ordinance.
Supervisor Tom Torlakson referred to the County' s waste
export agreement with Alameda County and the attempt to reach
agreement on an export agreement with San Jose. He noted that the
neighboring counties and cities required evidence of Contra Costa' s
progress in siting a landfill. He recommended that the Board defer
decision on the referendum until after the November 6, 1990
election.
IT IS BY THE BOARD ORDERED that decision on the
referendum petition against Ordinance 90-49, the Marsh Canyon
Development Agreement, is DEFERRED to December 4, 1990.
