SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
ACCEPT report from Chief Engineer on Sanitation District No. 15 Emergency Storage Pond
Fence project and DIRECT Chief Engineer to proceed with project.
II. Financial Impact:
Completion of a previously awarded contract for $61,314.50, funded;by Sanitation District No.
15 (100%).
III. Reasons for Recommendations and Background:
R. J. Law owns property adjacent to the Sanitation District No. 15 emergency storage pond site.
R. J. Law's letter of August 1, 1990 to the Board of Supervisors raises concerns about the
emergency storage ponds and the project to fence the District's property.
In 1978 Sanitation District No. 15 purchased the site from Boyd Development Company. The
company had built a sewage treatment plant on the site to service the Willows Park Marina
condominium project. In early 1979 the Sanitation District sewer collection system became
operational and pumped sewage to the plant for treatment. On November 23, 1983 the sewage

flow was diverted to the Oakley Bethel Island Sewage Treatment Plant (OBI).' The sewage
treatment ponds were retained for emergency storage in the event the force main to OBI is not
usable.
In December, 1986 a force main valve began to leak and the sewage flow was ,diverted to the
storage ponds. The south ponds were full and sewage was being storied in the north pond prior
to the force main being repaired. When the north pond was 3/4 full, water began to flow into
Law's backyard. It was never determined if the flow was ground water being squeezed from
under the ponds by the weight of the sewage or if it was the sewage seeping out,;of the storage
ponds. Subsequently, the north pond was lined to prevent any leaking and ',OBI has been
notified that all repairs to the force main must be completed prior to,the pond filling (approxi-
mately 72 hrs.).
It is imperative that the storage pond site be retained as a place to temporarily,,store sewage
when there is a problem with the force main to Oakley. The storage pond has been used four
times in the last twelve months. Without the Emergency Storage Ponds the sewage would have
been pumped into Dutch Slough.
In 1988 R. J. Law sent a letter to Sanitation District No. 15 claiming the existingfence was not
providing adequate security to the site. The Sanitation District No. 15 Citizens Advisory
Committee requested that a eight foot high chain link fence be installed around the property.
During the preparation of the fence plans it was discovered that the':existing fence was about
20 feet inside the property line. The Citizens Advisory Committee was informed of this and they
requested that the fence be placed on the property line.
The fence project consists of clearing and grubbing a strip along the property line, placing fill
as necessary to provide a level working surface and installing an eight foot high chain. link fence
on the property line. The project has been determined to be exempt from' the California
Environmental Quality Act as a Class 1 b Categorical Exemption, Section 15301. The project was
approved by the Board of Supervisors on July 10; 1990. A Notice of Exemption was filed with
the County Clerk.
Reclamation District No. 799 has reviewed the fence plans and determined that,the project will
not affect any of their drainage channels. The drainage corridor.will not be na'r'rowed nor will
any active ditch be filled. The drainage ditch on R. J. Law's property is a private ditch not
maintained by the Reclamation District.
An application for a U. S. Army Corps of Engineers permit has been submitted. A field meeting
between the District and the Corps was held on August 29, 1990. It was determined that to
mitigate the impacts of construction, four willow sprouts will be planted for each tree removed
and the riparian vegetation will be permitted to regrow in the area disturbed by:construction.
It is recommended that the Board DIRECT that the fence be installed..
IV. Consequences of Negative Action:
If the fence is not built the County will be obligated for the cost to cancel the contract and the
District will continue to be exposed to the liability of trespassers and encroachment.
