SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Approve Amendment No. 5 To Agreement with Miller, Starr &
Regalia, to increase payment limit by $20,000 .
2 . Authorize Board Chair to sign Amendment No. 5 on behalf of the
County.
FINANCIAL IMPACT:
This Amendment increases the payment limit on this legal services
contract by $20,000 . Payments under this contract are charged to the
West County Justice Center project account.
REASONS FOR RECOMMENDATIONS/BACKGROUND:
On January 26, 1987, the County entered into a contract for legal
services with Miller, Starr & Regalia, in connection with: a lawsuit
challenging the Board' s approval of the West County Justice Center, on
environmental grounds . (Pinole Point Properties , Inc. v. Board of
Supervisors, Action No. 291512) As amended, the current contract
ceiling on fees and costs is $65,000 .
Billings from the law firm now exceed $75, 000 . The action resulted
in a judgment in favor of the County, but an appeal filed by the
petitioner required substantial additional legal services . Increasing
the payment limit is necessary to pay current billings and to cover
future legal services related to the case.
