Date: SEP 1990 O y:$ APPROVAL OF. THIS ADJUSTMENT CONSTITUTES A PERSONNEL/SALARY RESOLUTION AMENDMENT. T �(1(1 (M-I!,7) 7/kn (Rev. 033 Attachment to P300 #15511 The Contra Costa County Board of Supervisors in all of its capacities as the governing body of this County and of the Districts and Agencies of which it is the governing body, in approving P300 #15511, further resolves that: 1. The Board has considered the financial impact of reductions in funding due to reduced state funding and federal funding and the impact of increased funding requirements, and has considered the staff retention plans submitted by the Social Services departments. 2. In order to keep expenditures within available funding, it is necessary to abolish the positions described in the P300 #15511, to which this is attached hereto, in the interest of economy or because the necessity for the position(s) involved no longer exists, and to lay off employees accordingly. Said P300 is incorporated herein by reference, and said positions are hereby abolished effective on the dates indicated thereon. 3. The Director of Personnel shall prepare lists showing the order of lay off of affected employees. 4. The County Welfare Director shall issue layoff or displacement notices, as the case may be, and give notice to the affected employees of the Board's action. 5. The Employee Relations Officer shall give notice of this Resolution to all recognized employee organizations. 6. To the extent that the subjects of this Resolution are within the scope of repr%5 entation under the Meyers-Milias-Brown Act (Government Code 3500 et seq. ) , this Board offers to meet with any recognized employee organization upon request concerning this Resolution. 7. Recognized employee organizations may submit to the Employee Relations Officer written requests to meet and confer on specific proposals with respect to the Resolution or any resulting layoffs. This authorization and direction is given without prejudice to the Board's right to reduce or terminate the operations and services of the County and of Districts governed by this Board and to eliminate classes of employees or positions as involving the merits, necessity, or organization or services or activities of the County of districts governed by the Board and not within the -scope of representation. 8. SUBJ: CANCELLATION OF DEPARTMENT PERMANENT-INTERMITTENT POSITIONS: FOR SEPTEMBER BOARD AGENDA 77 ------------------------------------------------------------------- BACKGROUNDJREASON FOR REQUEST On August 25, 1990, the Board of Supervisors acted (via P-300 #15503) to establish interim permanent intermittent :positions to alleviate the impact of layoff prior to early retirements. Although the request made by the Department (see attached) also asked for the cancellation of positions, that action was inadvertently not processed. As stated in the Department's memo of August 22 , the positions created were: 9 Social Worker, 2 .Social Work Supervisor I and 1 Social Service Program Assistant position. These positions corresponded to the maximum anticipated number of early retirements in those classes during the "window period" ending September 21, 1990. It is critical that the positions be canceled prior to the end of September and after the "window period" closes. Please call Judy Campbell at 646-5152 if you have any questions. Background/Reason for Request: This memo and the attached P-300 confirms our discussions with you and your staff and requests the interim creation of permanent- intermittent positions in the following classes: Social Worker - 9 Social Work Supervisor I - 2 Social Service Program Assistant - 1 As arranged with .you, these positions would be established to alleviate the impact on the Department of reductions due to layoff, demoting staff, and then re-hiring them after .,early retirements expected to occur by September 21. Our survey of employees eligible in these classes indicates that 9 Social Workers, 2 Social Work Supervisor I 's, and 1 Social Service Program Assistant would take early retirements; the positions to be created correspond to that expected number of retirements. The positions would. need to be established in advance of the September 1 layoff in order to allow displacement in seniority order by those employees with higher seniority 'among those to be laid off. The. P-300 further establishes a date of September 27 for the positions to be cancelled. This is necessary because if the estimated retirements do not materialize, a layoff from Social Worker would still need. to occur as originally authorized by the Board of Supervisors. By establishing the cancellation of -the positions at this time effective September 27, the Department can implement the remaining layoff/d-isplacement if necessary. We have reviewed benefit issues with the Personnel Department who indicate that full coverage would continue for the permanent- intermittent employees displacing and returning in September. This also influences the need to either re-hire or displace employees in September so as not -to inadvertently damage health coverage. Gen 9c (New 3/86) III. Financial Impact There will be limited fiscal impact to the Department's budget by some salary costs for the permanent intermittent workers during this 3-week period. This can be absorbed in remaining fiscal year action. IV. Consequences of Negative Action Employees and the organization would be unnecessarily disrupted and impacted by demotion and brief reassignments should this action not be effected. This action to be implemented, needs to be placed on the Board of Supervisors agenda for August 28 , 1990. Please contact Judy Campbell at 5152 with any questions concerning this matter.
