RECOMMENDED ACTION:
RELIEVE the apparent low bidder, William G. McCullough Company of Antioch, of its bid and REJECT
all other bids. DIRECT the Public Works Director to re-advertise the project early in the spring of 1991.
FINANCIAL IMPACT:
The second lowest bid is above the Engineer's Estimate. It is expected that advertising in the spring
of 1991 will result in more competition.
REASONS FOR RECOMMENDATION/BACKGROUND:
The Engineer's estimated construction cost was $139,450.60.
The apparent low bidder, William G. McCullough Company, has submitted to the Public Works Director
satisfactory proof under Section 5103 of the Public Contract Code that mistakes were made in the bid.
It is thus recommended that the bidder's request for relief be granted.
Of only three bids, the second and third bids were both higher than the Engineer's estimate. It is
hoped that, by calling for bids in the early spring of 1991, keener competition will result in better prices
for the County and the private property owners who are funding part of the project costs (via Deferred
Improvement Agreements).
CONSEQUENCES OF NEGATIVE ACTION:
If the low bidder is not relieved, it may seek legal action and the project could be indefinitely delayed.
Award to the second bidder would incur costs in excess of the Engineer's Estimate and the property
owners' expectations.

The plans and specifications were approved and the project advertised for bids by the Board of
Supervisors on July 31, 1990. The bids were received and opened at 255 Glacier Drive, Martinez,
California,. on Thursday, August 30, 1990. The construction bids received were as follows:
