HomeMy WebLinkAboutMINUTES - 09111990 - 1.82 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 11, 1990 by the following vote: AYES: Supervisors McPeak, Torlakson, Fanden NOES: None ABSENT Supervisors Powers , Schroder ABSTAIN: None SUBJECT: Determination of Property Tax) Transfer for the Blackhills ) RESOLUTION NO. 90/ 589 Boundary Reorganization ' ) (LAFC 90-29) ) WHEREAS, Section 99 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been provided previously shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer for the annexing district; and.. WHEREAS; the Blackhills Boundary Reorganization (LAFC 90-29) involves annexation of territory to the Central Contra Costa Sanitary District and the East Bay Municipal Utility District for which property tax exchange is determined by a previously approved master property tax exchange agreement; and WHEREAS, the reorganization also involves annexation of territory to County Service Areas P-2A and M-23 (CSA P-2A and CSA M-23) and the concurrent detachment of a portion of the affected territory from the East Bay Municipal Utility District which are not subject to an existing property tax exchange agreement. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that there shall. be no transfer of property tax to CSA P-2A and CSA M-23 as a result of this reorganization and that any property tax revenue generated in the portion of the affected, territory to be detached from the East Bay Municipal Utility District shall be transferred and distributed proportionately to the agencies serving the area exclusive of school agencies. The terms of this property tax exchange agreement shall be effective for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. This resolution does .not change the property tax revenues accruing to other agencies serving the subject territory or the affected agencies right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
