MICHAEL WALFORD, CHIEF ENGINEER DATE: SEPTEMBER 11, 1990 SUBJECT_: MIRANDA CREEK BYPASS PIPE, ALAMO AREA Project No.: 7505-6F8486 Task: ACQ Account: 3540 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Right of Way Contract and ACCEPT Grant of Easement dated August 27, 1990, from Francis Paul Ryan and Carole Ryan. B. AUTHORIZE the Chief Engineer to execute said Right of Way Contract on behalf of the District. C. APPROVE payment of $2,050 for said property rights and AUTHORIZE ,.the Auditor- Controller to issue a check in said amount payable to Francis Paul Ryan and Carole Ryan, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have the above referenced Grant of Easement recorded in the office of the County Recorder. LI. Financial Impact: The funds for the District's portion of the acquisition costs will be drawn from the Drainage Deficiency Trust fund 8121. Reasons for Recommendations and Background: Miranda Creek is unable to pass the 25 year storm discharge from its crossing with Erselia Trail to a point approximately 1.50 feet downstream. This section of Miranda Creek is located in the Alamo area. The Developer of Subdivision 7099 is discharging drainage into Miranda Creek at Erselia Trail and is thus conditioned to perform creek improvement work. The Developer is further conditioned to widen Erselia Trail. This affects the road culvert under Erselia Trail and the immediate downstream section of, the creek. The District's participation. in the creek improvement work ensures that additional flood protection is provided downstream of the Developer's work at Erselia Trail. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction.in- accordance with the approved:plans and specifications.
