HomeMy WebLinkAboutMINUTES - 08071990 - 2.9 2 . 9 I THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August"7, 1990, by the following vote: AYES: Supervisors Powers , Schroder, McPeak, Torlakson, Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Initiative to Adopt Marsh Creek ) Corridor Preservation Area to ) Prevent Development of Landfill ) Therein ) A petition to adopt the subject Initiative to Adopt the Marsh Creek Corridor Preservation Area to Prevent Development of any Landfill therein was presented to the County Clerk for filing. The County Clerk has examined the signatures and has determined that the petition contains a number of valid signatures, which is not less than ten percent (10%) in number of the entire vote cast in the County for all candidates for governor at the last gubernatorial election. Therefore, this Board hereby ORDERS as -follows: 1 . The Initiative to Adopt the Marsh Creek Corridor Preservation Area to Prevent Development of Landfill Therein shall be submitted to the voters at the next November 6 , 1990 statewide election according to the ballot measure set forth below. 2 . The ballot language and measure for submittal of the -- subject initiative to the voters is as follows : "Initiative to Adopt Marsh Creek Corridor Preservation Area to Prevent Development of Landfill Therein. Shall the ordinance amending the general plan and other land use regulations in the unincorporated area of southeastern Contra Costa County designated the 'Marsh Creek Corridor Preservation Area, ' bounded on the west by Morgan Territory Road, on the south by the Alameda County boundary, on the east by Vasco Road, and on the north by Marsh Creek Road and Camino Diablo, to prohibit the development of any landfill in such area until December 31, 2020, be adopted?" 3 . The Clerk is directed to mail a copy of the complete text of the initiative ordinance with the sample ballot to each voter at least 10 days before the aforementioned election by including it in and with the ballot pamphlet. 4 . If the order entered on August 6, 1990 in Contra Costa County Superior Court Action No. C90-02918 (Waste Management of North America, Inc. v. County of Contra Costa) is not modified, stayed or otherwise set aside on or before 5 : 00 p.m. , August 26 , 1990, this order shall be of no further force or effect after that date and no November 6 , 1990 election shall be conducted on the said initiative. 1 hereby certify that this Is a true and correct COPY of LTF/jh an action taken and entered on the minutes of the Orig.
