Adoption of Procedures for Fund Management. and Expenditures.
SPECIFIC REQUESTS) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
1. Adopt a resolution (see Exhibit A) requesting the Contra Costa
Transportation Authority include with the County' s allocation from
the Local Street Maintenance and Improvement Program for Fiscal
Years 88/89 and 89/90, any interest earned on this allocation
.while on deposit with the Authority;
2 . Direct the County Auditor to establish a separate, interest-
bearing Measure C Transportation Improvement Fund in accordance
with Measure C, and deposit all Measure C Local Street Maintenance
and Improvement Funds in the Fund, advancing $350, 000 for growth
management compliance purposes and allocating $1, 111, 900 for
transportation purposes pursuant to the Five-Year County Road
Improvement Program;
3 . Direct the County Administrator to incorporate the funding of the
County's Growth Management Program into the current County-wide
fee study, and, if appropriate, to recommend adjusting development
fees to include: a) the reimbursement of the Measure C
Transportation Improvement Fund for its advance of funds for
growth management compliance efforts, and b) ongoing growth
management compliance costs; and
-4 . Designate the Community Development Department as lead agency to
administer the . Fund for accounting purposes, establishing
procedures allowing the Public works Department to directly charge
the fund up to the allocation limit for transportation.
FINANCIAL IMPACT
Approval of -this recommendation will provide anticipated Measure C
sales tax revenues to fund the County's activities to comply with the
Measure C Growth- Management Program and to fulfill transportation
improvements identified in the County Road Improvement Program.

Interest on Measure C Funds and Administrative Procedures
BACKGROUND
On August 7, 1990, the Board of Supervisors directed the Community
Development Director to complete and certify the Interim Initial
Compliance Checklist to the Contra Costa Transportation Authority
(CCTA) as the Statement of Compliance with the Measure C Growth
Management Program. After review of the Checklist, the CCTA has found
the County making satisfactory progress with the Measure C Growth
Management Program, and has agreed to release the County's allocation
of $1, 511,900 from the Local Street Maintenance and Improvement Fund
for Fiscal Years 1988/89 and 1989/90, less $50, 000 previously received
by the County in Fiscal Year 1989/90 for growth management compliance
purposes.
The County's allocation of $1, 511, 900 identified by the Authority does
not include interest earned on the County's allocation while on deposit
with the Authority. The Community Development Department estimates
that interest earned by this allocation amounts to over $60, 000.
Withholding of interest is consistent with the terms and conditions
which the Board approved on January 23 , 1990 in order to receive the
County's initial allocation of $50, 000 for growth management compliance
activities. Subsequent actions and proposals of the CCTA have defined
local responsibilities to fund Measure C growth management activities.
To maximize the sales tax revenues available to the County and cities
to fund growth management compliance activities and local street
maintenance and improvements needs, the Transportation Committee
proposes that all revenues collected for the Local Street Maintenance
and Improvement Program, including any interest earned on these funds,
be returned to the local jurisdictions as part of their allocation.
Section 14 of the Measure C ordinance requires each city and the County
to establish a separate Transportation Improvement Account for deposit
of Measure C revenues and collection on any interest earned from these
revenues. Creation of the Measure C Transportation Improvement Fund
will satisfy this requirement during the 20-year life of the program.
Acceptance of the Measure C funds constitutes an agreement by the
County that the funds will be expended consistent with the requirements
of Measure C, subject to verification by an audit if such an audit is
deemed appropriate by the Authority. Eligible expenditures include the
County' s compliance efforts with the Measure C Growth Management
Program, local road maintenance and improvement projects, and sub-
regional and regional transportation projects, consistent with Article
XIX, Section 1(a) of the State Constitution.
The $350, 000 allocation for growth management compliance purposes is
based on the draft program guidelines issued by the Authority. The
budget for this allocation is attached as Exhibit B. $180, 000 is for
contracts not presently included in the Community Development
Department's budget. The budget contains several major tasks that are
necessary to establish the growth management program, and will not be
repeated annually, allowing smaller allocations for growth management
compliance in future years.
The growth management allocation also reduces the Department's demands
on the Road Fund. The Community Development Department anticipates the
need for $450, 000 from the Road Fund for Fiscal Year 1990/91 to fund
the County's transportation planning activities. $127, 000 is
attributed to growth management compliance efforts in Exhibit A, and
can be met with Measure C funds (and perhaps eventually development
fees) , freeing $127, 000 from the Road Fund for transportation projects.
Actual costs for growth management compliance may change once the CCTA
has adopted guidelines for their growth management program, and once
cost-sharing agreements are made with the cities for funding the four
Regional Transportation Planning Committees. Interest received from
the CCTA on the County's allocation of Measure C revenues, and any
interest earned on the County's Measure C Transportation Improvement
Trust Funds, will be reserved as a contingency for this fiscal year.
Any surplus will be carried over into the next fiscal year.

Interest on Measure C Funds and Administrative Procedures
The County Administrator's Office will explore the possibility of
funding compliance efforts with fees on new development. If this
funding source is appropriate, the development fees will reimburse the
Measure C Transportation Improvement Fund for the $350, 000 and other
necessary amounts advanced for growth management compliance
expenditures. The intention will be to use development fees as a
permanent funding source for growth management compliance efforts,
allowing all Measure C sales tax revenues to be used for street and
road projects.
The County Road Improvement Program for Fiscal Years 1990/91-1994/95
(adopted April 19, 1990) , identifies the projects to receive the
$1, 111, 900 Measure C allocation for transportation purposes. These
projects are based on the County Road Improvement Policy (Resolution
89/306) which established the following priorities for road projects
receiving Measure C funds: 1) safety, 2) reconstruction, 3)
rehabilitation, and 4) traffic congestion relief of problems which
existed before November 1988. These priorities are consistent with
expenditures allowed by Measure C.
CONSEQUENCES OF NEGATIVE ACTION
Without adoption of the resolution requesting interest earned on the
County's Measure C allocation, the County will pass the opportunity to
receive an estimated $60, 000 in Measure C revenue.
Without establishing a separate, interest-bearing fund for the deposit
of such revenues, the County will forfeit all or a portion of its
Measure C revenues.
Without advancing $350, 000 in Measure C revenue for growth management
compliance, the Department will not be able to satisfy all eight
components of the Measure C Growth Management Program, jeopardizing the
allocation of future Measure C revenue to the County.
Without allocating $1, 111,900 in Measure C revenue for transportation
purposes, projects in the County Road Improvement Program will be
dropped or deferred.

The Board of Supervisors of Contra Costa County RESOLVE:
WHEREAS, Measure C establishes the Local Street Maintenance
and Improvement Program at 18 percent of the total revenue
generated by the Measure C half-cent sales tax; and
WHEREAS, revenues for the Local Street Maintenance and
Improvement Program are the only Measure C sales tax funds
specifically allocated to the County and the cities for local
programs; and
WHEREAS, Section l.d. of the Terms and Conditions for the
Measure C Growth Management Allocation, approved by the Board of
Supervisors on January 23, 1990, requires any interest earned on
revenues generated for the Local Street Maintenance and Improvement
Program remain with the Contra Costa Transportation Authority
(CCTA) ; and
WHEREAS, the CCTA has apportioned over 86 percent of the $10
million in sales tax revenue generated for Regional Transportation
Planning and Growth Management for the CCTA' s use; and
WHEREAS, the draft Measure C Growth Management Program will
require the County and the cities to allocate local funds to
finance the multi-jurisdictional transportation planning process
and other growth management requirements established by Measure C;
and
WHEREAS, these additional planning requirements reduce the
Local Street Maintenance and Improvement Program Funds available
for local street and road purposes.
NOW THEREFORE, the Board of Supervisors of Contra Costa County
does hereby request the Contra Costa Transportation Authority to:
1. Amend Section l.d. of the Terms and Conditions for Growth
Management Allocations so that any interest earned on the
revenues generated for the Local Street Maintenance and
Improvement Program will be available for allocation to the
County and the cities; and
2 . Include with the County's allocation from the Local Street
Maintenance and Improvement Program for Fiscal Years 1988/89
and 1989/90, any interest earned on this allocation while on
deposit with the Authority.
