SUPPORT FOR AN EXPANDED FEDERAL INTERCEPT PROGRAM
SUBJECT:
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position in support of the effort of the California
County Revenue and Reimbursement Officers Association (CCRROA) to
seek passage of federal legislation which would authorize a
federal intercept program similar to the existing state intercept
program and expand such a federal program to cover a variety of
debts owed the County. ,
BACKGROUND:
Currently the federal government has an intercept program under
which outstanding child support obligations can be withheld from
any federal income tax refund to which a parent is otherwise
entitled. The State of California has a similar program for
child support obligations. However, the State also has a "State
Tax Intercept Program" under which counties can intercept State
income tax refunds from debtors where the county has a court
order requiring repayment of such debts as civil judgments,
public defender fees, court fines, civil assessments, etc. , in
addition to _ child support. Currently, Contra Costa County
receives about $150,000 a year from the State intercept program.
The State Department of Social Services is interested in pursuing
federal legislation which would authorize a federal intercept
program for overpayments under the AFDC, Medi-Cal and Food Stamp
Programs. The CCRROA has discussed with the State the

possibility of expanding their proposed federal legislation to
include debts owed to counties. The State has expressed no
particular opposition to such a proposal. Our Director, Office
of Revenue Collection, Nancy Bischoff (who is also the
President-Elect of CCRROA) recommends that the Board of
Supervisors join other counties in indicating their support for
federal legislation which would allow recovery from federal
income tax refunds for all such debts in addition to child
support obligations.
It is anticipated that such a federal intercept program would net
the County $225,000 to $240,000 a year in additional revenue. It
is therefore recommended that the Board of Supervisors indicate
its support for such federal legislation. Alameda County has
agreed to act as coordinators for the counties' efforts in this
regard.
