COSTA COUNTY

RECOMMENDATIONS
Adopt a resolution designating . the Contra Costa Transportation
Authority as the congestion management planning (CMP) agency for
Contra Costa County pursuant to AB 471 and AB 1791, and as the
countywide transportation planning agency pursuant to AB 3705, and
requesting clarification by the OCTA on the following points:
(1) How will the locally-prepared deficiency plans be incorporated
into the CMP?
(2) Will local jurisdictions be held accountable for failing to
meet traffic service levels due to another agency's inaction?
(3) What process will be used for approving the Congestion
Management Plan that assures local consensus?
FINANCIAL IMPACT
The financial impact of the CMP designation has an unknown impact
at this time because the Authority has not determined the cost of
the Congestion Management Plan. Local contributions for CMP
staffing on consultant studies may be required to prepare the CMP
and annual update it. The Authority proposes to minimize these
costs by coordinating the CMP process with the Measure C Growth
Management Program. Any costs to the County associated with the
CMP process should be considered an administrative expense for
receiving the additional local gas tax revenues from Proposition
III. These revenues should be used to fund any County costs
associated with the CMP Process.

REASONS FOR RECOMMENDATION/BACKGROUND
The passage of Proposition 111 in June resulted in a new planning
requirement for local governments in California. In order to
qualify for the new gas tax funds, every county that includes an
urbanized area of 50, 000 or more people must prepare, adopt and
annually update a countywide Congestion Management Program (CMP) ,
which includes five elements: (1) standards for traffic levels of
service (LOS) on a designated road system; (2) standards for
transit service; (3) a trip reduction and travel demand element;
(4) an analysis of the impact of land use decisions on the regional
transportation system; and (5) a 7-year capital improvement program
to maintain or improve traffic levels of service.
If the analysis indicates that LOS standards would not be met for
particular intersections or roadway segments, local jurisdictions
must prepare "deficiency plans" for that intersection or segment.
The CMP agency must make an annual finding of conformance by local
jurisdictions with the CMP, and MTC in turn must find the adopted
CMP to be consistent with the Regional Transportation Plan. In the
event the CMP agency finds a local jurisdiction not in conformance
with the CMP, it can notify the State Controller to withhold
payment of local subvention funds attributable to the new gas tax.
The first year's allocation of funds to the County is estimated to
be $2 .4 million.
The agency responsible for preparing the CMP must be jointly
designated by the County Board of Supervisors and a majority of the
cities of the County, representing a majority of the population.
The Contra Costa Transportation Authority has requested designation
as the CMP agency for Contra Costa County.
The CMP planning process closely parallels the requirements of
Measure C, which the Authority is currently implementing in
conjunction with its regional transportation planning committees.
It is logical, therefore, for the same organization to prepare both
plans.
A related countywide planning program is embodied in AB 3705
(Eastin) , which was passed by the Legislature in 1988 . This law
allows counties to prepare countywide transportation plans, which
are submitted to MTC for incorporation into the Regional
Transportation Plan (RTP) . AB 3705 gives the County the
opportunity to participate in the development of the Regional
Transportation Plan and to assure consistency with local needs and
priorities. It is therefore recommended that the CCTA also be
designated as the AB 3705 planning agency and that a consolidated
Countywide Transportation Plan-Congestion Management Program be
prepared and submitted to MTC. Since the AB 3705 plan will provide
the basis for the Regional Transportation Plan as it pertains to
Contra Costa County, there is little likelihood that MTC would find
the CMP inconsistent with the RTP.
Be aware that designation of the CCTA as the CMP agency will change
the current process for incorporating the County's priority list
for highway projects into the State Transportation Improvement
Program (STIP) . Project lists will ho longer be developed by the
City County Engineers Advisory Committee and submitted to the Board
of Supervisors and Mayors Conference for approval. With the CMP
agency designation, responsibility for establishing project
priorities for State funding would be transferred to the Authority.
In reviewing the requirements of the CMP, staff identified the
following issues affecting local jurisdictions which need to be
addressed by the CCTA:

1. Programming projects identified in local deficiency plans
The deficiency plans prepared by local jurisdictions for road or
intersections that do not meet traffic level of service standards
will include capital improvements. These improvements must be
included in the capital improvement program of the CMP in order to
be incorporated into the Regional Transportation Improvement
Program and become eligible for Flexible Congestion Relief funding.
It is not clear how local deficiency plans and the projects they
identify will be included in the CMP.
2 . Actions required by other agencies
Attainment of traffic service levels may require action by agencies
such as Caltrans, a neighboring jurisdiction, or a transit agency.
In the event timely action is not taken by these agencies, local
traffic level of service standards may not be met. Local
jurisdictions need assurance from OCTA that these circumstances
would not result in a finding of nonconformance by the CCTA,
jeopardizing receipt of local subvention funds.
3 . Plan approval process
Since the CMP will directly affect local jurisdictions, it may be
desirable to require approval of the CMP by the County and by a
majority of cities representing a majority of the population of the
county, similar to the process for designating a CMP agency. Local
plan adoption procedures should be specified by CCTA.

SUBJECT: RESOLUTION SUPPORTING DESIGNATION OF THE CONTRA COSTA
TRANSPORTATION AUTHORITY AS THE CONGESTION MANAGEMENT PLANNING
AGENCY FOR CONTRA COSTA COUNTY AND THE AGENCY RESPONSIBLE FOR
PREPARING AND ADOPTING A COUNTYWIDE TRANSPORTATION PLAN
WHEREAS, the State of California has enacted into law Assembly Bill 471 (Chapter 106, July
10, 1989), Senate Bill 300. (Chapter 105, July 10, 1989) and Assembly Bill 1791 (Chapter 16,
March 12, 1990), which provide for an increase in the gasoline sales tax of nine cents over the
next three and a half years in order to finance transportation improvements; and
WHEREAS, this legislation requires the development, adoption and implementation of
countywide "Congestion Management Programs" by an agency to be jointly designated by the
cities and the County; and
WHEREAS, the Contra Costa Transportation Authority was created pursuant to California
Public Utilities Code Section 180000 et. seq. to administer the Contra Costa Transportation
Improvement and Growth Management Program approved by the voters in November 1988; and
WHEREAS, the planning requirements of the Congestion Management Program closely
parallel the County's Transportation Improvement and Growth Management Program; and
WHEREAS, the Contra Costa Transportation Authority has requested designation as the
Congestion Management Planning agency for Contra Costa County; and
WHEREAS, the State of California has also enacted into law Assembly Bill 3705 (Chapter
752, September 7, 1988), authorizing counties together with the cities of the county to designate
an agency to prepare a Countywide Transportation Plan which shall be used by the Metropolitan
Transportation Commission as the primary basis for the Commission's Regional Transportation Plan;
and
WHEREAS, state law requires the Metropolitan Transportation Commission to make a finding
that a locally adopted Congestion Management Plan is consistent with the Commission's Regional
Transportation Plan; and
WHEREAS, the Board of Supervisors of Contra Costa County desires to coordinate and
facilitate the transportation planning process in the county, to expedite the construction of needed
transportation improvements, and to ensure that the Metropolitan Transportation Commission's
Regional Transportation Plan recognizes the distinctive needs of Contra Costa;

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors of Contra Costa County
hereby designates the Contra Costa Transportation Authority as the Congestion Management
Planning agency for Contra Costa County pursuant to AB 471, SB 300 and AB 1791 ; and
BE IT FURTHER RESOLVED, that the Board of Supervisors of Contra Costa County hereby
designates the Contra Costa Transportation Authority as the agency responsible for preparing and
adopting a Countywide Transportation Plan pursuant to AB 3705; and
BE IT FURTHER RESOLVED, that the Board of Supervisors of Contra Costa County requests
clarification from the Contra Costa Transportation Authority regarding the following:
(1) How will locally-prepared deficiency plans be incorporated into the CMP Capital
Improvement Program?
(2) Will local jurisdictions be held accountable for failing to meet traffic level of service
standards due to the inaction of another agency?
(3) What process will be used for approving Congestion Management Plan that assures
local concensus?
BE IT FURTHER RESOLVED, that copies of this resolution shall be forwarded to the Contra
Costa Transportation Authority, to the cities of Contra Costa County, and the Contra Costa County
Mayor's Conference.
