RECOMMENDATION: DENY request of Mike Carpenter, 306 Lava Court, Martinez, for County participation in repair of his fence on the boundary adjoining the Juvenile Hall property. REAFFIRM County policy of installing and maintaining fencing along boundaries of County properties only when it is in the interest of Contra Costa County, or when required by California Environmental Quality Act (CEQA) mitigation measures and installed in accordance with standards set by the County. CONCUR in General Services Department staff recommendation that fencing is not required along the borders of the Juvenile Hall property at this time. II. FINANCIAL IMPACT: A change in County policy with respect to fencing along County properties would most likely be extremely expensive; the costs could run into the millions of dollars. III. BACKGROUND: Mike Carpenter owns property at 306 Lava Court, Martinez, which is on the southern boundary of the County' s Juvenile Hall property. His and other private properties border the southern and a portion of the western boundaries. The fence at the rear of Mr. Carpen- ter' s property is of wood, and it extends across the rear of all the private properties. According to records of the City of Martinez, the fencing was installed on these properties by the developer of the subdivision (Tract 4822) , circa 1976. On the Juvenile Hall side of the southern boundary, there is a ten-foot wide strip of ground with trees, and then a paved access road from Glacier Drive. On June 14, 1990, Mr. Carpenter contacted General Services staff requesting that the County share in the cost of repairing his rear fence. J' DEPUTY r _ " property, is privately owned, and has not been damaged by the County. A similar request in 1982 from another owner of property along the southern boundary was also denied. Mr. Carpenter, by letter to the Board dated June 21, 1990, then requested that the County install fencing across the southern property line, similar to that installed at the new Sheriff ' s building on Muir Road. If fencing were to be installed along the southern and western boundaries of Juvenile Hall, the cost for the kind of fence requested by Mr. Carpenter is estimated to be $150,000 to $180,000, based on the costs for the fence at the Sheriff ' s building on Muir Road. In constructing new facilities, the practice is to install fencing only to satisfy County security and safety needs or to mitigate impacts as determined by the CEQA process. In these cases the fencing is constructed to standards set by the County. The above recommendations are consistent with present and past practice and policy for the many properties owned and controlled by the County, including building sites, airports, roads, flood control channels, Southern Pacific Right-of-Way, etc. cc: General Services Department Administration County Administrator Public Works Director County Probation Officer Mike Carpenter 306 Lava Court, Martinez CA 94553
