SUBJECT: Hearing on Appeals of Lucia Albers and Eugene A. Leyba,
Et Al, On Land Use Permit 2117-88 in the Byron Area.
This is the time heretofore noticed by the Clerk of the Board of
Supervisors for hearing on the appeals of Lucia Albert and Eugene A.
Leyba, et al from the decision of the East County Regional Planning
Commission on the request by Lucia Albers (applicant and owner) to
establish an outdoor recreation facility, including miniature golf,
go-carts and batting cages on seven acres of a larger 73 . 4 acre parcel
(LUP 2117-88) in the Byron area.
Mary Fleming, Community Development Department, presented the
staff report on the Land Use Permit request for the outdoor recreation
facility, describing the proposed site location, commenting on the
Planning Commission recommendation, and the appeals before the Board
today. She advised of the staff recommendation that the Board support
the decision of the East County Regional Planning Commission, deny the
appeal of Gene Leyba and David Preiss representing Lucia Albers, and
uphold the decision of the Planning Commission subject to conditions
of approval.
The public hearing was opened and the following persons appeared
to speak:
David Preiss, Preiss and Hammer, 1981 N. Broadway #420, Walnut
Creek, representing Lucia Albers, commented on issues including the
appeal of conditions of approval on road improvements and road
dedication. Mr. Preiss also referred to a document from Scandia
relative to the proposed center.
Lucia Albers, 1400 Deer Valley Road, Brentwood, applicant/owner,
commented on the proposed project. Mrs. Albers advised of her
willingness to provide for an area of benefit and dedicate land for
future road widening.
Wayne Farnholtz , 954 Country Lane, Walnut Creek, spoke in favor
of the proposed project.
Sharon Jensen, Rt. 1, Box 75 P, Brentwood, spoke in opposition to
the project.
Eugene A. Leyba, 3280 Bixler Road, Brentwood, spoke in opposition
to the project.
Jean Davide Crandell, Rt. 1 , Box 82, 3505 Highway 4 , Byron, spoke
in favor of the proposed project.
James E. Switzer, 4616 Kinsella Lane, Sacramento, spoke in favor
of the proposed project.
Donna Rowe, 1779 Dune Pt. Way, Byron, spoke in opposition to the
project.
\ David Preiss spoke in rebuttal.
Supervisor Torlakson and Mr. Preiss discussed the road
improvement conditions.
Lucia Albers spoke in rebuttal.
The Board discussed the matter.
The hearing was closed.
Supervisor Powers moved to defer decision on this matter for one
week.
Supervisor Schroder seconded the motion.
Supervisor Torlakson commented on various concerns, requesting
Board members to take a trip and look at the property, and Public
Works and Health Department to comment on the issues of water and
traffic and he moved a substitute motion to defer the decision for two
weeks.
Supervisor Powers concurred.
IT IS BY THE BOARD ORDERED that the decision on the above appeals
is DEFERRED to the August 14, 1990 Determination Calendar; and
Community Development Department, Public Works Department, and the
Health Department staff are REQUESTED to address concerns raised in
today' s hearing.
