Bragdon Director of Conmmnity Development County DATE: July 31, 1990 SUBJEcr: Ordinance Adopting and Increasing Fees for Planning Services SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Hold public hearing and hear public comment on the Ordinance Adopting and Increasing Fees for Planning Services. 2 . Find that pursuant to Government Code sections 54986 and 54992 , the Clerk of the Board mailed 14 days' notice of the time and place of this hearing, including a statement that the ordinance to be considered proposes adopting and increasing fees for planning services, and a statement that . data indicating the estimated cost of providing planning services, and the revenue sources anticipated to provide the services shall be available to the public 10 days before this hearing date. 3 . Find that the Community Development Department has made available to the public data indicating the estimated cost of providing- the planning services and the revenue sources anticipated to provide the services, at least 10 days before the above hearing date. 4. Adopt the Ordinance Adopting and Increasing Fees for Planning Services. FISCAL IMPACT 1. The fee increase is requested to lessen dependence on funds from the County General Fund. 2 . New fees ' are necessary to support hazardous waste review tasks required by Ordinance 86-100. Pursuant to Government Code sections 59986 and 54992, the Clerk of the Board mailed 14 days' notice of the time and place of this hearing, including statements that financial data was available to the public 10 days prior to hearing date and that the hearing was for purposes of adopting and increasing fees for planning services, and at least 10 days before this hearing, the required financial data was made available to the public by the Coimm pity Development Department. 2. Current Planning and Advance Planning activities are supported by application fees. In addition, County funds have also been used to support costs associated with these activities. In an effort to minimize the County funds used, it is proposed that fees be increased. 3. Hazardous waste project review tasks necessary under proposed revision of County Ordinance 86-100 (Hazardous Waste/Materials Projects) require funding. The new fee will support staff costs to perform the Ordinance's required tasks. ORDINANCE NO. 90-62 (Adopting and Increasing Fees for Planning Services) The Board of Supervisors of the County of Contra Costa ordains as follows: SECTION I. Authority. This ordinance is enacted, in part, in accordance with the provisions of Government Code sections 54985 et seq. , 54990 et seq. , 65909 .5, 65941 .5, 65962, 66451 . 2, and Public Resources Code section 21089 . SECTION II . Fees . The fees for land use permits, other entitlements, appeals, and certain other services furnished by the Community Development Department are listed in Exhibit A attached to this ordinance and incorporated herein by this reference. SECTION III . PRIOR ORDINANCE. Upon the effective date of this ordinance, Ordinance No. 86-94 is repealed and replaced by this ordinance, except that obligations due and owing pursuant to Ordinance No. 86-94 remain in full force and effect, and are not relieved by the adoption of this ordinance. SECTION IV. Severability. If any fee or provision of this ordinance is held invalid or unenforceable by a court of competent jurisdiction, that holding shall not affect the validity or enforceability of the remaining fees or provisions, and the Board of Supervisors declares that it would have adopted each part of this ordinance irrespective of the validity of any other part. SECTION V. Effective Date. This ordinance shall become effective 60 days after passage, and within 15 days of passage, shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times, a newspaper of , general circulation published in this County.
