SUBJECT: STATUS OF DRAFT COUNTY GENERAL PLAN AND RELATED ELECTION PROPOSALS
SPECIFIC I2EQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Accept the report of the Director of Community Development
regarding the status of proposed urban limit lines and the
proportions of urban and open space lands reflected in the
Draft County General Plan.
2 . Direct the Community Development Department to work with the
18 Contra Costa Cities to ensure maintenance of the 65%/35%
open space/urban proportions previously approved by the Board
for inclusion in the revised Draft General Plan
3 . Accept the report of County Counsel on the development of a
proposed land presevation plan measure and direct counsel to
report to the Internal Operations Committee on July 30, 1990
with a draft of such a measure with the intent to gain Board
of Supervisors approval to place such a measure before the
voters in the November, 1990 general election.
4. Direct County Counsel to prepare a concurrent, separate ballot
measure regarding preservation of rail corridors for transit
purposes.

BACKGROUND/REASONS FOR RECOMMENDATIONS
On July 23, 1990, the Director of Community Development and County
Counsel presented reports on the status of the development of urban
limit lines for the County General Plan, the proportions of urban
and rural uses implicit in the plan, and related election proposals
designed to implement . provisions of the revised draft plan
previously approved by the Board of Supervisors for inclusion in
the revision of the draft plan.
The Director of Community Development indicated that staff had made
no major modifications to the proposed urban limit lines from those
presented to the Board. In addition, Mr. Bragdon related the
results of area measurements made of the urban and open. space
proportions of total land use in the draft plan as follows:

On the basis of the foregoing, the Community Development Department
infers that of the 45, 000 acres currently designated for open space
use within. the urban limit line, approximately 24, 000 acres could
be converted to urban uses while achieving the 65/35 Open
Space/urban development goal articulated by the Board of
Supervisors. At the same time, some 21, 000 acres would be required
for permanent open space uses.
It should be noted .that some adjustments to these figues may occur
in order to conform the exact placement of the urban limit line,
taking into account normative planning boundaries and limiting
factors such as slope, ridgeline preservation, local geological
suitability and the like. Nevertheless, these preliminary figures
are suitable fordefining the analysis required to comply with the
California Environmental Quality Act.
The committee recommends that staff be directed to work with the
cities toward comprehensive implementation of the goal of 65% of
the County being maintained as open space.
The committee also cautions that the area currently proposed for
inclusion within the urban limit line should be considered the
outer limit of the area of potential development under the proposed
plan for the purpose of environmental impact analysis.
County Counsel presented the Committee with the attached. report
defining a process which would place a land preservation measure on
the November, 1990 General Election Ballot. The process outlined by
Mr. Westman would bring a draft initiative ordinance to this
committee for recommendation to the Board of Supervisors. The
Committee recommends that that process be undertaken immediately
and has therefore tentatively scheduled an Internal Operations
Committee meeting for July 30, 1990 pending confirmation from the
committee members and meeting space availability. Consideration by
the full Board of Supervisors should be scheduled for July 31,
1990.
The committee also recommends that a ballot measure be place befor
the voters which would preserve rail corridors throughout the
County for transportation purposes, namely rail transit.

Re: Proposed Land Preservation Plan Measure
With your guidance, the staff (the Community Development
Department and the County Counsel's Office) has been developing the
new draft County General Plan. In this regard, staff now asks that
your Committee and the Board also consider the concept of a proposed
ordinance measure it has formulated for the November 6, 1990 election
to provide for and ensure land preservation within the County. A
summary of this proposed ordinance concept ismhereinafter set forth.
If your Committee and/or the Board determines that this concept
should be pursued, staff at your direction, will prepare a complete
ordinance draft for your further consideration. In this event, we
suggest Committee review of a complete draft ordinance on July 30,
1990 (Monday) and Board of Supervisor's review and public comment on
July 31 , 1990 (Tuesday) . Thereafter, a final draft could be prepared
by staff for Board consideration on August 7, 1990 and possible
election adoption.

CONFINE DEVELOPMENT TO 35% OF THE LAND WITHIN THE

IDENTIFIES THE OUTER BOUNDARIES OF URBAN DEVELOPMENT,
AND (4 ) RESTRICT HILLSIDE DEVELOPMENT THROUGHOUT THE

TAT OF PROPOSED ORDINANCE
MEASURE
The People of the County of Contra Costa ordain as follows:
Section 1 Title
This ordinance shall be entitled the "65/35 Contra Costa County Land
Preservation Plan" .
Section 2 Summary
This ordinance directs the Contra Costa County Board of Supervisors
to include a 065/35 Contra Costa County Land Preservation Plan" in
its new General Plan for the County, which requires:
Internal Operations Committee -3- July 23, 1990
Restrict development to 358 'of the land in the County and
preserve 658 of the land in the County for agriculture, open
space, wetlands, parks and other non-urban uses;
Create an Urban Limit Line, which sets the outer boundaries
of urban development during the period of the new General
Plan;
Increase the minimum parcel size for lands designated in the
new General Plan as "Agricultural Core" to 40 acres;
Protect and promote the economic viability of agricultural
lands by appropriate standards and policies;
Restrict development of open hillsides and significant
ridgelines throughout the County by zoning and other
' measures; ,
Prohibit any changes to the 65/35 Preservation Plan standard
except by a vote of the people;
Prohibit any changes to the Urban Limit Line by the Board of
Supervisors except by a 4/5 vote in limited circumstances;

Direct the Local Agency Formation Commission to honor the
County's growth management standards in annexation decisions;

Promote cooperation between the County and cities to preserve
agricultural and open' space lands, wetlands and parks, by
requiring the County to pursue preservation agreements with
cities; and
Safeguard the County's obligation to provide its fair share
of safe, decent and affordable housing.
