SUBJECT: Land Use Initiative for the Unincorporated
Area of Contra Costa County
The Board received a memorandum dated July 16, 1990 from
Robert J. Delevati, Assistant County Registrar, transmitting the
attached certification of the petition for the Land Use Initiative
for the Unincorporated Area of Contra Costa County.
The Board received the attached memorandum dated July
19, 1990 from Victor J. Westman, County Counsel, advising of
alternative actions the Board may take concerning the petition.
After discussion by Board members, IT IS ORDERED that
the following actions are APPROVED:
1. DEFERRED decision to August 7, 1990 on the Land Use
Initiative for the Unincorporated Area of Contra Costa
County;
2. DIRECTED County Administrator to report on the fiscal
impact of the Initiative; and
3 . DIRECTED County Counsel to prepare documentation for the
Board' s consideration to place the Initiative on the
November 6, 1990 ballot.

On July 16, 1990, the County Clerk filed his certifications on the pending
"Land Use Initiative for the Unincorporated Area of Contra Costa County" (the
Land Use Initiative) and the "County Initiative to Adopt Marsh Creek Corridor
Preservation Area" (the Marsh Creek initiative). To require action by the Board
of Supervisors, an initiative petition must be signed by not less than in number
10% of the entire vote cast in the County for all candidates for governor in the
last gubernatorial election preceding the publication of notice of intent to
circulate the involved initiative petition. The Clerk has indicated that this
10% number is 25,123.
The Clerk's certifications indicate that the petition for the Land Use
Initiative contains 28,726 valid signatures and that the Marsh Creek Initiative
contains 35,466 valid signatures. Because both initiative petitions meet the
minimum 10% valid voter signature requirement, Elections Code § 3711 requires
that the Board of Supervisors take one or more of the following actions
concerning each petition:
1. Adopt the Initiative(s). Since both initiative petitions have
qualified, the Board of Supervisors may pass one or both without change.
2. County Reports. Pursuant to Elections Code § 3705.5, the Board may
refer one or both of the initiative measures to a county agency or agencies for
a report or reports on their fiscal impact, effects on the County's General Plan
and Zoning, or any other matter the Board requests be reported on. Any report(s)
must be presented to the Board within any time prescribed but in no event later
than 30 days after the Clerk has certified (July 16, 1990) the sufficiency of
the petitions.
3. Calling Elections. If the Board does not adopt the initiatives without
change or upon the receipt of any ordered report or reports, the Board must
submit the initiatives to the voters at the next state-wide election occurring
not less than 88 days after the date of its election order. The election or
elections could be called on or before August 9, 1990 without interfering with

I, STEPHEN L. WEIR, County Clerk, County of Contra Costa,
State of California, do hereby certify that I did examine the LAND
USE INITIATIVE FOR THE UNINCORPORATED AREA OF CONTRA COSTA COUNTY
and find that said petition contains 28 , 726 valid signatures of
registered voters within Contra Costa County.
The entire vote cast in Contra Costa County for all
candidates for Governor at the last Gubernatorial Election was
251,308.
