SUBJECT: Declaration of Support of the Proposed Mid-State Tollway as a Candidate for the AB680
Privatization of Transportation Facilities Program
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
It is recommended that the Board declare its support of the proposed Mid-State Tollway as a
Candidate for the AB680 Privatization of Transportation Facilities Program by adopting the
attached resolution.
II. Financial Impact:
There will be no impact to the General Fund and no new impact to funds previously designated
for Delta Expressway.
Ill. Reasons for Recommendations and Background:
Assembly Bill (AB)680, which was approved by Governor Deukmejian last July, permits Caltrans
to test the feasibility of building privately funded transportation facilities by developing four
demonstration projects throughout the State, including at least one in northern California.
Caltrans will be selecting a qualified and experienced company or consortia who can design,
obtain environmental approval, provide right of way, finance, construct and operate toll revenue
transportation projects in California without the use of federal or state funds.
Caltrans is conducting a two-stage screening and selection process in seeking qualified compa-
nies/consortia. The first, which resulted in the selection of ten consortia, involved determining
which were qualified. The second stage will involve the submittal of conceptual plans by the
selected companies/consortia for building and operating one or more projects.

III. Reasons for Recommendation/Background (Cont.)
No specific projects have been identified by the State. It will be the responsibility of the
companies/consortia who participate in the second stage of the screening to propose one or
more projects that are believed to provide a reasonable rate of return in relation to the
associated risk and investment and provide improved transportation services within the State.
The projects proposed in the second stage must be in accordance with state and local laws
including all environmental and land use regulations. Additionally, no proposed projects will be
selected unless a free public transportation facility exists as an option to be used by those who
choose to not use the toll facility.
A few consortia have indicated their interest in a proposed inter-regional project that runs from
1-505 in Vacaville to 1-680 in Sunol, the Mid-State Tollway. The East County Corridor is being
considered as a portion of the proposed project. The East County Corridor is a proposed
regional transportation corridor that runs from the SR4/160 junction in Antioch to 1-580 in
Livermore, and includes Delta Expressway, the proposed re-routing of SR4 through Oakley and
Brentwood.
There are several criteria that will be used by Caltrans to determine which projects are selected
during the second stage: transportation service provided by proposal; degree to which
proposal encourages economic prosperity and makes overall good business sense; relative
ease of proposal implementation; relative experience and expertise of the company/consortium
on similar projects; degree to which proposal supports the State's Environmental Quality and
Energy Conservation Goal; degree to which non-toll revenues support proposal costs; degree
of technical innovation; degree of proposal's support for achieving the civil rights objectives of
the State (MBE/WBE utilization); and degree of local support for proposal.
IV. Consequences of Negative Action.
Lack of local support may lead to the disqualification of the Mid-State Tollway as a potential
AB680 project. This would result in losing an opportunity to construct the East County Corridor.
