Sanitary Landfill (Proposed "Garaventall Landfill)

RECOMMENDATIONS
1. Deny, without prejudice, General Plan Amendment 6-85-CO.
2 . Accept the request of the project sponsor, Contra Costa Waste Services,
Inc. , to withdraw the application for Land Use Permit 2111-86.

None.
BACKGROUND/REASONS FOR RECOMMENDATION
General Plan Amendment. On June 5, 1990, the electorate declined to approve
Proposition B on the Contra Costa County ballot, which, had it passed, would
have upheld the Board of Supervisors, October 10 and 17, 1989 approval of an
amendment that included the East Contra Costa Sanitary Landfill in the County
General Plan. The October 1989 amendment was originated by the Board. The
failure of Proposition B precludes the Board from adopting a similar element
for at least one year. General Plan Amendment 6-85-CO, which was originated
by the project sponsor (formerly S and J Enterprises) in 1985, is essentially
identical to the East Contra Costa Sanitary Landfill amendment which was
defeated in the June election. It (GPA 6-85-CO) is technically still before
the Board, having stalemated through a tie vote in 1988. Since it cannot be
approved at this time and since the sponsor is requesting the withdrawal of
the Land Use Permit, there is no point in keeping the amendment alive.

Land Use Permit 2111-86. As was the case with the General Plan Amendment 6-
85-CO, Land Use Permit 2111-86 technically remains before the Board for
decision. The project sponsor's attorney, Michael McCabe, in a letter dated
June 14, 1989, has requested that the application be withdrawn. For this
reason, and because the permit cannot be approved without its being
consistent with the General Plan, staff recommends that the Board approve the
withdrawal of the application.
Fiscal Impact. The sponsor's application fees are not returnable inasmuch as
the project has been through the hearing process. The unexpended portion of
the fee paid by the sponsor in 1989 to update the project's Environmental
Impact Report (EIR) , insofar as that fee pertains to the EIR consultant's
contract, will be returned. The sponsor requested the work on the updated
EIR be terminated; it is being closed out.
